Ordinance 1986-002 Code Enforcement Procedures Repeat ViolationORDINANCE NO. 2 - 1986 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-171, SECTION 2-178 AND SECTION 2-179 OF THE VILLAGE OF NORTH PALM BEACH CODE. ' BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 2-171 of the Village of North Palm Beach Code is hereby amended to read as follows: Section 2-171. Declaration of Le_islative intent. It is the intent of this article to promote, protect and improve the health, safety and welfare of the citizens of North Palm Beach and to provide an equitable, expeditious, effective and inexpensive method of enforcing the hereinafter described Codes and Ordinances of the Village where a pending or repeated violation continues to exist. Section 2. Section 2-178 of the Village of North Palm ' Beach Code is hereby amended to read as follows: Section 2-178. Fines. The Enforcement Board, upon notification by the Code Inspector that a previous order of the Enforcement Board has not been complied with by the set time or, upon finding that the same violation has been repeated by the same violator, may order the violator to pay a fine not to exceed $250 for each day the violation continues past the date set for compliance. A certified copy of an order imposing a fine may be recorded in the public records and thereafter shall constitute a lien against the land on which the violation exists or, if the violator does not own the land, upon any ' other real or personal property owned by the violator; and it may be enforced in the same manner as a court judgment by the sheriffs of this state, including levy against the personal property, but shall not be deemed to be a court judgment except for enforcement purposes. After 6 months from the filing of any such lien which remains unpaid, the Enforcement Board may authorize the local governing body attorney to foreclose on the lien. No lien created pursuant to the provisions of this chapter may be foreclosed on real property which is a homestead ' under Article X, Section 4 of the State Constitution. Section 3. Section 2-179 of the Village of North Palm Beach Code is hereby amended to read as follows: Section 2-179. A eal. An aggrieved party, including the Village Council, may appeal a final administrative order of the Enforcement Board to the Circuit Court of Palm Beach County. Such an appeal shall not be a hearing de novo, but shall be limited to appellate review of the record created before the Enforcement Board. An appeal shall be filed within thirty (30) days of the execution of the order to be appealed. Section 4. This Ordinance shall take effect immediately upon passage.
