Ordinance 1985-015 Limiting Location for Sale of Alcoholic BeveragesORDINANCE N0. 15-85 ' AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 45 OF THE VILLAGE OF NORTH PALM BEACH CODE BY LIMITING THE LOCATION OR PLACES OF BUSINESS WHERE SUCH ALCOHOLIC BEVERAGES MAY BE SOLD IN RELATION TO CHURCHES, SCHOOLS, HOSPITALS, PARKS AND PLAYGROUNDS, RESTAURANTS AND PUBLIC LICENSED RETAIL SELLERS OF ALCOHOLIC BEVERAGES. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. That Chapter 45 of the Village of North Palm Beach Code is hereby amended by adding thereto Section 45-36(N), which said subsection shall read as follows: "(I) No licensed retail sales of alcoholic beverages shall be carried on where the proposed place of business is within 1,000 feet of a church, public or private school, hospital, park or playground, or a place of business of another licensed retail seller of alcoholic beverages. (2) The measurement provided above for 1,000 feet shall be made or taken from the main front entrance or entrances~of such church, public or private school, hospital, park or playground, or a place of business of another licensed retail seller of alcoholic beverages, to the main front entrance of the applicant's proposed place of business along the route of ordinary pedestrian traffic. (3) The restrictions of Section 45-36 shall not apply to the sale of beer, ale or wine at retail, not to be consumed on the premises. (4) The restrictions of Sections 45-36 shall not apply to any presently existing licensed retail seller of alcoholic beverages so long as such licensee continues to be so licensed at its present location, nor to any bona fide restaurant as defined and licensed under Florida Statutes as a restaurant with full kitchen facilites, regardless of size or seating capacity, where alcoholic beverages are served solely as an accessory use to the restaurant at tables only and not at a bar and only when such restaurant is open for the sale and service of food; provided, however, that the provisions of this subparagraph (4) shall not permit a license to be issued under this Ordinance for restaurants or other licensed retail sale of alcoholic beverages where the proposed place of business is within 1,000 feet of ' a church, public or private school, hospital, public park or public playground."
