AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH,
FLORIDA, AMENDING THE VILLAGE CODE BY SUBSTITUTING THE CODE
ENFORCEMENT BOARD FOR THE BOARD OF ADJUSTMENT IN CODE SECTIONS
14-44 AND 14-46.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM
' BEACH, FLORIDA:
Section 1. Section 14-44 of the Village of North Palm
Beach Code is hereby amended in whole to read as follows:
"Section 14-44. Request for Hearing. The person
to whom notices are directed pursuant to Section
14-41, or their duly authorized agents, may file
a written request for hearing before the Code
Enforcement Board of the Village within the five
(5) day period of compliance prescribed in
Section 14-41 for the purposes of defending the
charges by the Village."
Section 2. Section 14-46 of the Village of North Palm
Beach Code is hereby amended in whole to read as follows:
"Section 14-46. Removal of Property from
Premises. If the violation described in the
notice given pursuant to Section 14-40 has not
been remedied within the five (5) day period of
compliance, or in the event that a notice
requesting a hearing is timely filed, a hearing
is had, and the existence of the violation is
affirmed by the Code Enforcement Board of the
Village, the Director of Public Safety or his
designee shall have the right to take possession
of the abandoned, wrecked, dismantled,
inoperative or junked property and remove it from
the premises. It shall be unlawful for any
person to interfere with, hinder, or refuse to
allow such person or persons to enter upon
private property for the purpose of removing such
property under the provisions of this article."
Section 3. This Ordinance shall take effect
immediately upon passage.
