03-11-1958 VC REG-M• MINUTES OF A REGULAR MEETING OF THE VILLAGE COUNCIL OF NORTH. PALM BEACH HELD AT THE NORTH PALM BEACH COUNTRY CLUB MARCH 11., 1958 ' Present: Richard E, Ross - Mayor Jay H. White - Vice-Mayor Charles A. Cunningham - Councilman Herbert A. Ross - Councilman John A. Schwencke -Councilman Albin R, Olson - Village Manager Robert C. Tufford - Village Clerk Absent: C. Robert Burns - Village Attorney ' Mayor Ross called the meeting to order and requested the Clerk call the roll. Mayor Ross 'requested the Clerk read the minutes of a regular meeting o£ the Village Council held on February 25, 1958. On motion o£ Councilman Schwencke, seconded • by Councilman Cunningham, all members voting aye, the minutes were approved as read. Mayor Ross informed the Council he had no report to make at this time. A notice that the U & Me Transfer Company, 621 First Street, West Palm Beach, had applied to the Florida Railroad and Public Utilities Commission for temporary authority to operate to and from United, Florida, and the metropolitan areas of Palm Beach County, was read to the Council. No ob3ection was heard to the granting of this temporary authority and the Village Manager was instructed to so notify the applicant. An application for a permit received from the Bankers Life and Casualty Company to fill certain described upland property located east of State Road No. 5 out to the Bulkhead Line established to Village Ordinance No. 31 was read to the Council. On motion of Councilman Ross, seconded by Councilman Schwencke, all members voting aye, the Village Clerk was authorized to grant the requested permit sub3ect to approval of the permit application by the Village Attorney. On motion o£ Councilman Schwencke, seconded by Vice-Mayor White, all members voting aye, proposed Ordinance #32 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY, FLORIDA, AMENDING ORDINANCE N0. 20, BEING THE COMPREHENSIVE 20NING ORDINANCE OF THE VILLAGE BY REMOVING CERTAIN PROPERTY FROM °R-2", ' MULTIPLE FAMILY DWELLING DISTRICT AND RECLASSIFYING SAID PROPERTY AS °R-1't, SINGLE FAMILY DWELLING DISTRICT; BY REMOVING CERTAIN PROPERTY FROM "C-lA", LIMITED COMMERCIAL DISTRICT AND RECLASSIFYING SAID PRO- PERTY AS "R-2", MULTIPLE FAMILY DWELLING DISTRICT; AND BY REMOVING CERTAIN PROPERTY FROM "C-lA", LIY~IITED COMMERCIAL DISTRICT AND RECLASSI- FYIATG SAID PROPERTY AS "C-1", NEIGHBORHOOD COMMERCIAL DISTRICT. was placed on second and final reading and read by title only. FLORIDA, AMENDING ORDINANCE N0. 20, BEING THE COMPREHENSIVE 2CNING ORDINANCE OF THE VILLAGE BY REMOVING CERTAIN PROPERTY FROM "R-2", MULTIPLE FAMILY DWELLING DISTRICT AND RECLASSIFYING SAID PROPERTY • AS "R-1", SINGLE FAMILY DWELLING DISTRICT; BY REMOVING CERTAIN PRO- PERTY FROM "C-lA", LIMITIED COMMERCIAL DISTRICT AND RECLASSIFYING SAID PROPERTY AS "R-2", MULTIPLE FAMILY DWELLING DISTRICT; AND BY REMOVING CERTAIN PROPERTY FROM "C-lA", LIMITED COMMERCIAL DISTRICT AND RECLASSIFYING SAID PROPERTY AS °C-ln, NEIGHBORHOOD COMMERCIAL DISTRICT was enacted. The Statistical Data Report for the month of February, 1958, was read by the Village Manager, ' The matter of renewal of village insurance policies was reported by Council- man Schwencke. Councilman Schwencke stated he had reviewed the five proposals received and because the proposal submitted by B. D. Cole, Inc., West Palm Beach, more closely fulfilled the needs of the Village he recommended the insurance be placed. with that firm. On motion of Councilman Ross, seconded by Vice-Mayor White, all members voting aye, the Village Manager was instructed to place the insurance with B. D. Cole, Inc., West Palm Beach, in accordance with the proposal submitted, The Village Manager reported the proposed franchise agreement between the Southern Bell Telephone Company and the Village as previously arranged was reported unacceptable to the Southern Bell Telephone Company unless so much of the aggregate amount of taxes and fees provided for in the proposed franchise as exceeds 1% of the aggregate bills for exchange service of customers receiving service within the munici- pality may be billed pro rata to such exchange customers. • The Southern Bell Telephone Company reported that such a provision is included in their General Exchange Tariff. After discussion of the matter, on motion of Councilman Ross, seconded by Councilman Cunningham, all members voting aye, the matter of a franchise agreement with the Southern Bell Telephone Company was tabled for further consideration. The Village Manager requested the Council consider the acquisition of a beach area adjacent the Atlantic Ocean for the exclusive use of village residents. Councilman Cunningham, representing the owners of the land areas adjacent the beach, expressed the desire of the land owners to cooperate with the village residents in making a beach area available for this use, Mayor Ross appointed Councilman Cunningham and Councilman Ross a committee ' to study the matter and report their recommendations at s later date. On motion of Vice-Mayor White, seconded by Councilman Schwencke, all members voting aye, the attached list of accounts payable were approved £or payment. There being no further business to come before the Council, on motion of Councilman Cunningham, seconded by Councilman Schwencke, all members voting aye, the meeting was adjourned at 9:25 P.M. to meet March 25, 19$8 at the North Palm Beach Countxyr Club.
