MINUTES OF A REGULAR MEETING OF THE
VILLAGE COUNCIL OF NORTH PALM BEACH
HELD AT THE NORTH PALM BEACH COUNTRY

Mayor Roas called the meeting to order and requested the Clerk call the
Mayor Ross requested the Clerk read the minutes of a regular meeting of
• the Village Council held on November 26th., 1057. On motion o£ Councilman Schwencke,
seconded by Vice-Mayor White, all members voting aye, the minutes were approved as
read.
Mayor Ross complimented the Volunteer Fire Department for its initiative
in making plans for a Christmas party for the village children, He expressed the
Council's desire that citizens of the Village participate in community activities
and that these activities expand,
Mayor Ross stated arrangements had been made to decorate the Village Hall
and expressed the hope that as many village homes as possible would be decorated
during the holiday season. The Mayor offered to donate a $50 War Bond as a prize
for the best docorated home, and instructed the Village Manager to appoint a com-
mittee to ,judge the decorated homes,
A report of a committee appointed at the previous meeting to study the
need for an ordinance to regulate dogs running at large within the village was
read by Councilman Cunningham, The committee report recommended the Council con-
sider an ordinance which would in effect prohibit dogs from running at large.
The Village Manager and Village Attorney were instructed to investigate
the matter and prepare an ordinance for council consideration,
On motion of Councilman Ross, seconded by Vice-Mayor White, all members

Mr. Lee C. Shepard, Jr., Certified Public Accountant, West Palm Beach,
commissioned to conduct an audit of the village accounts during the fiscal year
1956-1957 submitted his report to the Council.
The report was read aloud and discussed by the Council. Councilman
Schwencke commended Mr. Shepard for an excellent report and expressed the appre-
ciation of the Council.
Councilman Ross reported he had further discussed the matter of a
municipal street light contract with Florida Fower and Light Company as an out-
' growth of the discussion which had taken place at the previous council meeting.
Because the Florida Power and light Company street light contract provides for the
use of wooden poles and a standard light fixture of a type not desirable for use
within the village, Councilman Ross suggested the council consider dher sources
for street lighting equipment.
Councilman Cunningham expressed his desire to have a basic street lighting
program started within the village as soon as possible because of the urgent need.
The Village Manager was instructed to review the cost of street lighting
equipment as previouly presented the council-and resubmit cost estimates at the
next meeting.
The Village Manager distributed the Statistical Data Report for the month
of November to the Council.
Three sealed bids received for the installation of a proposed fire siren
on the water tower were opened by the Village Manager. The bids received were as
follows: Arrow Electric Co., $354; Crowe Electric Co., $155; Worsham Electric Co.,
X125.00.
' On motion of Councilman Schwencke, seconded by Councilman Ross, all mew ers
voting aye, the Village Manager was instructed to award the contract to the lowest
bidder, Worsham Electric Company.
The matter of bids for the renewal of village insurance policies was dis-
cussed. The Village Manager requested the matter be held in abeyance until February
' 195$, at-which time the major portion of the insurance in force is due for renewal.
On motion of Councilman Schwencke, seconded by Vice-Mayor White, all members
voting aye, the Village Manager was instructed to renew the police patrol car on
expiration in December, and secure bids for all village insurance at the expiration
o£ the remaining policies in February,

. On motion of 'Councilman Schwencke, seconded by Councilman Ross, all members
voting aye, accounts payable, as listed on attached sheet, in the amount of X388.36
were approved for payment.
' Mr. Clem Vandenburg, 106 Anchorage Drive, addressed the Council concerning
the maximum millage that may be assessed real property within the village. Council-
man Ross explained the Charter provides a maximum levy o£ 10 mills and that future
increased building volume would result in a greatly enlarged tax base.
Mr. Walter Dolan, Jr., 1101 Ebbtide Drive, addressed the Council concerning
the matter of regulating dogs within the village. Mr. Dolan stated many strangers
' enter the village and emphasized the desirability of having dogs for the protection
of both property and individuals,
Mr. Louis J. Aiello, Jr ., l~Itl Flotilla Road, stated he is the owner of a
dog and is in favor of an ordinance regulating their activity.
• Mr. Harold Eaton, 1t0lt Gulf Road, stated that although he looks upon dogs
with favor he feels their owners should keep them within their own property.
Mr. Charles Bowman, 136 Flotilla Road, requested information concerning
the insurance coverage provided in the case of volunteer firemen. He was advised
insurance policies now in effect provide coverage for volunteer firemen injured
on duty.
Mr. Joseph Tuilino, 50lt Bay Road, questioned the Council concerning items
previously read in the audit report submitted by Mr. Lee Shepard,
' Mr. Tulino questioned the expenditure of funds for the boat yard and dock
facilities. Mayor Ross explained the equipment for the operation of the small boat
facility would not be paid for by the village but would probably be leased to the
village for $1 per year.
Mr. Tulino questioned the matter of charges assessed the village for rental
of the Village Hall. Councilman Schwencke stated the rental charges had been a
matter o£ considerable study by the Council. He further explained the charges had
been verified by the Certified Public Rccountant employed to audit the village
accounts and that a statement to the effect that the charges were not excessive
was included in the audit report. Councilman Schwencke then r ead the following
letter dated December 6, 1957, addressed to Mr. C. Robert Burns, Village Attorney:

• Dear Sir
At a meeting last night held in the Village Hall with a group of
the local residents we proposed that the present owners of the Village
Hall, namely, North Palm Beach Properties, Inc., would agree to sell
the Village Hall to the Village under the following conditions:

The amount used for the cost of the building has been verified by
independent audit by Mr. lee Shepard, a local certified public account-
ant, whose report will be ready on next Tuesday and a copy of which
should be included as part of our contract,
' The land amount of $89,775 is arrived at by an appraisal dated November
19th. that is enclosed herewith.
2. It was agreed by all that we would execute a contract now before
the first of the year so that we could remove the property from
the tax rolls. This contract would be in the form of a contract
to purchase in the above stated amount. The amounts received by
North Palm Beach Properties from the Village for rents for the .

chase price. As of January 1, 1960, the Pillage would begin pay-
ing the balance in equal monthly installments at six (6) per cent
interest on a twenty year basis.

• 3. As part of the agreement our company, North Palm Beach Proper-
ties, Inc., would agree to occupy the building jointly during
this interim period and as a consideration for the occupancy
would be therefore waiving any interest payments on the amount
owed on the building,
' The above proposal was completely acceptable to all of the people that
attended the meeting except for one major problem which was whether or
not on January 1, 1960, the Village would have need for the space. We,
therefore, agreed that we would draw the contract on some basis so that
if on January 1, 1960, they felt that they did not need all of the space
or that the Village income was not sufficient to support 'an operation
of this type that they would be able to drop the contract and let the
amounts already paid in be full satisfaction for the cancellation,

Hallett, Mr. J. F, Johnson, Mr, Albert Lowe, Mr, Edward J, Lucas, Mr, Quentin Millar,
and Dr. J. Edwin Obert,
Mr, Thomas G. Hart, Jr., 1118 Anchorage Drive, stated he felt the X89,000
figure listed as the appraised value of the land to be an excessive cost to the
village.
Mr. Albert Lowe, 1132 Flotilla Road, Mr. Edward Lucas, 404 Ebbtide Dr,,
Mr. Roy Cuthrell, 482 Anchorage Dr., Mr, Quentin Millar, 413 Gulf Road, and Mr,
Birger Petterson, 409 Driftwood Road, spoke in favor of the village acdepting
the proposal to purchase the Village Hall as offered, Emphasis was placed on the
provision that the matter would be submitted to the vote of the freeholders at
a later date at which time the financial capability of the village to enter into
the contract would be clearer.

Mayor Richard E. Ross announced North Palm Beach Properties, Inc., will
donate the tress located in its nursery adjacent the Country Club for the use of
the village as it desires. The village manager was instructed to study the matter
and meet with a citizen group to determine the disposition of these trees.
There being no further business to come before the Council, the meeting
was adjourned to meet at the call of the Mayor in January.
