Ordinance 1983-011 Adopts Standard Mechanical Code 1982 EditionORDINANCE N0. 11-83 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ~J AMENDING CHAPTER 17.5 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE MECHANICAL CODE FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO THE STANDARD MECHANICAL CODE, 1982 EDITION, AND SETTING FORTH AMENDMENTS TO SAID STANDARD MECHANICAL CODE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 17.5-1 of the Village of North Palm Beach Code is hereby amended to read as follows: "Sec. 17.5-1. ADOPTED BY REFERENCE---Under the authority of ect on or a to utes, the Village of North Palm Beach hereby adopts by reference thereto the Standard Mechanical Code, 1982 Edition, and the recommended amendments of the Building Code Advisory Board of Palm Beach County, as the Mechanical Code for the Village. There has been for at least ten days last past and shall be during the time that this code is in effect, three copies of such code and recommended amendments-kept available for public use, inspection and examination." 1 Section 2. (Village Seal) f ATTEST: `~r~, ~ i age erc ep y ~~. ~~ 1 UNIFORM, MINIMUM COUNTYWIDE AMENDMENT TO THE STANDARD MECHANICAL CODE, 1982 EDITION AS RECOMMENDED BY THE BUILDING CODE ADVISORY BOARD OF PALM BEACH COUNTY 1 ' March 16, 1983 The Standard Mechanical Code, 1982 Edition is amended by the following revisions, additions and deletions: Section 102.1 - Mechanical Official. Delete and substitute the following: There is hereby established a Mechanical Inspection Division, within the Building Department, which shall be in charge of the official so legally designated by the local governing body. Section 102.2 - Inspectors. Delete the existing paragraph and substitute the ' following: The Building Official with the approval of the Chief Appointing Authority of the governing body may appoint such number of officers, inspectors, assistants and other employees as shall be authorized from time to time. No person shall be appointed as inspector of mechanical systems who has not had at leave five (5) years experience as a mechanical inspector, engineer, or as a superintendent, foreman, or competent mechanic in charge of mechanical construction. The inspector appointed 's hall be certified within 12 months of appointment by the Building Officials Association of Florida. Section 103.6 - Amend as follows: Delete paragraphs (b), (c) and (d) and add the following: See Section 103.6 of the Standard Building Code for Product Control ' requirements. Section 103.7 - Amend by identifying the existing paragraph as sub-section (a) and add a new sub-section (b) to read: (b) Any suit brought against any former employee of an agency for actions said employee may have taken in the discharge~of his duties while employed by said agency will be defended by the agency. Section 104_3 - Form. Delete and substitute the following: F.ach application fora permit with the required fee, shall be filed with the Building Official on a form furnished for that purpose and shall contain a general description of the proposed work and its location. The application shall be signed by the owner, or his authorized agent. Section 104.4 - Drawings and Specifications. Delete and substitute the ' following: 4!henever, in the opinion of the Building Official, drawings and specifi- cations are needed to show definitely the nature and character of the work for which the application is made, the applicant shall furnish such drawings and specifications. These drawings and specifications shall be returned to the applicant, marked reviewed and one set shall be retained and filed as a -1- permanent record in the office of the Building Official. The applicant's permitted set shall remain at all times on the fob. Such information or draw- ings and specifications shall be specific, and this code shall not be cited as a whole or in part, nor shall the term "legal" or its equivalent be issued as a substitute for specific information. 1. All drawings, specifications and accompanying data shall bear the ' name, signature and address of the designer. 2. Pursuant to Chapter 471 F.S. and Chapter 481 F.S. said 'designer shall be either a state registered architect or a state registered engineer (or be exempt therefrom) and shall perform only those services which he is authorized by law to perform. 3. Provided, however, that no person shall be required to be so registered to make plans and specifications for, or supervise the erection, enlargement or alteration of: A. Any building upon any farm for the use of any farmer regardless of the cost of the building: B. Any one family or two family residence, building or domestic out building appurtenant to any one family er two family residence regardless ' of cost; or C. Any other type building costing less than $25,000.00 except schools, auditoriums or other building intended for public use. 4. Provided further that this code shall not be construed to prevent any employee of an architect or engineer from acting in any capacity under the instruction, control, or situation of the architect or engineer, or prevent any person from acting as a contractor in the execution of work designed by an architect or engineer. (See also Attachment No. 1). Section 105.2 - Delete and substitute the following: CONDITION OF THE PERMIT The Building Official shall act upon application fora permit with plans as filed, or as amended, without unreasonable or unnecessary delay. A permit ' issued shall be construed to be a license to proceed with the work and shall not be construed as authority to violate, cancel, alter, or set aside any of the provisions of this code, nor shall such issuance of a permit prevent the Building Official from thereafter requiring correction of errors in plans or in construction, or of violations of this code. Any permit issued shall become invalid unless the work authorized by it shall have been commenced within -2- six (6) months after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of six (6) months after the time the work is commenced; provided, that for cause, one or more extensions of time for periods not exceeding ninety (90) days each, may be allowed in writing by the Building Official. Section 105.3 - Annual Industrial Permits: Add new section. Upon written request to the Building Official, any industrial plant may ' be issued an annual permit for mechanical work, installation, maintenance and equipment rearrangement covering units, ducts, and piping in or bn the premises owned or occupied by the holder as described in the permit, but to be issued subject to the following conditions: (1) The payment of an annual fee of one hundred ($100) dollars for each calendar year, and permit fees computed monthly according to the fee schedule above. (2) The regular employment of one or more full time mechanics competent in the safe installation, extension, maintenance and repair of industrial mechanical systems and equipment. (3) The right of the Mechanical Inspector to check the premises of the ' permit holder at a reasonable time, unless prohibited by government regulations. (4) The performance of all work shall comply with the applicable provi- sions of this chapter. , (5) The annual industrial permit shall cover the rearrangement of industrial equipment including extension of duct systems required therefor and inspection fees therefor. Section 105.4 - Qualifications of Applicant. Add new paragraph. Application for permits shall be accepted only from contractors currently licensed in their respective field and for whom no revocation or suspension of license is existing except that a sole owner may make application for permit and install the work in connection with the construction, replacement or alter- , ations of a single family residence or two family residence for his own use and occupancy and not intended for sale. Such licensed contractor or sole ' owner shall be held responsible to the Building Official for the proper super- vision and conduct of all work covered thereby. ., -3- Section 106.3 - Schedule of Permit Fees. Delete existing paragraph and sub- stitute the following: On all mechanical work covered by this code.requiring a permit as set forth in section 104, a fee shall be paid as required at the time of filing application in accordance with the fee schedule established by A reinspection fee of $10.00 may be charged for ' each reinspection made due to the refection of work, or due to the fact that work was not ready at the time specified in the request for inspection, or failure to call for inspection: Payment of such fee must be made prior to the reinspection. Plan Filing Fee - 30% of estimated permit fee upon filing. Deduct amount from actual fee if permit is obtained within four (4) months from approval date; if not, permit fee is kept. Ma or working drawing review fee - $100.00 deducted from permit fee if permit is obtained within eight (8) months from submission date. Major changes fee after plans are app roved and permit issued - $250.00 fee but in no case more than the original permit fee. Major plan rechecking fee - Second (2nd) and additional check lists - ' 10% of permit fee for checking service each time rechecked. Section 109 - Violations and Penalties. Delete existing paragraph and sub- stitute the following: Any person, firm, or corporation who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, shall be guilty of misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which arty violation of any of the provisions of the Code is committed or continued, and upon convic- tion of any such violation, such person shall be punished by a fine of not less than fifty ($50) dollars nor more than five hundred ($500) dollars, or by im- prisorrnent not exceeding six (6) months, or by both such fine and imprisonment. Section 110 - Appeals. Delete section and substitute the following: ' (a) Whenever the Building Official shall reject or refuse to approve the mode or manner of construction proposed to be followed or materials to be used in the erection or alteration of a building or structure, or when it is claimed that the provisions of the code do not apply, or that an equally good or more desirable form of construction can be employed in arty specific case, or when it ,^ is claimed that the true intent and meaning of this code or any of the regula- tions thereunder have been misconstrued or wrongly interpreted, the owner of -4- building or structure, or his duly appointed agent, may appeal from the de- cision of the Building Official to the Board of Adjustments and Appeals. Section 111 - Board of Adjustments and Appeals. Delete existing section and substitute the following: The Board of Adjustments and Appeals as established by Section 111 of the Standard Building Code, shall hear all appeals concerning the interpreta- tion and enforcement of this code. ' Section 112 - Delete. Section 201 - Definitions. Delete the existing first paragraph 'and subsitute the following: For the purpose of this code, the following terms shall have the meaning indicated in this chapter and as. listed in the Standard Building Code. Section 301.2 - Approval. Add the following: Heat recovery systems or auxiliary appliances when installed as part of arty air conditioning or refrigeration system shall be approved for such installation by a recognized testing agency. External water and hot gas lines on such units shall be insulated or protected to prevent accidental burning. Unless superseded by the Standard Building, Mechanical or Gas Codes as ' amended, or altered or waived by a licensed engineer and the Building Official, mechanical equipment will be installed according to the manufacturers instruc- tions, recommendations or technical manuals. Section 302.1 - Add to paragraph. The requirements. of Section 303.2 in this code shall apply to air condi- tioning equipment. Section 303.3(b) - Attic installation. Delete and substitute the following: All air conditioning and heating equipment installed in an attic or furred space shall have an accessible disconnect switch and a 110-120 volt a/c grounding type convenience outlet convenient to the general equipment area. In an attic, a light, located at the service side pf the equipment, controlled by a switch located. at the required passageway opening shall be provided. ' Section 303.3(c) - Add new paragraph. Appliances installed in attic spaces shall be supported from the top chords of trusses or roof framing as approved by the design engineer and Building Official. -5- 'I Section 303.5(f) - Add new paragraph. All appliances .ins tailed on roof shall be provided with vibration isolation so as not to create objectionable noise or hazard to structural members. Section 303.11(a) - Add to existing paragraph: Ail solar collectors sha}1 be certified by the Florida Solar Energy Center, ' except owner constructed solar collectors. Section 308.9 b -Add to existing 'ara~ra'h: "and must meet the requirements of 503(b)2(B)." Section 510(b)3(D) - Delete complete. Section 513 - Air Filters. Delete second sentence regarding low velocity type filter. ; Section 514 - Change eighteen (18) inches to read twenty four (24) inches. Section 603.2 - Delete in code and substitute the following: All condensate piping shall be galvanized steel, copper pipe or tubing or rigid plastic pipe. Black steel. pipe shall not be used. Rigid plastic pipe shall be a minimum of PVC schedule 40. Condensate lines shall be a minimum of three/ fourths (3/4") inch size pipe of seven/eighths (1/8") size copper tubing size. The pipe or tubing must be sized in accordance with good engineering practices. In no case shall the condensate line be smaller than the outlet of the unit it serves, unless an eccentric reducing fitting is used. Connections to the unit drain may be either flexible connections or rigid piping and shall be provided with a trap having a minimum three inch seal. Flexible connections used to form a trap shall not exceed eighteen (18") inches in length. Care should be taken to prevent double trapping. Air conditioning or any water from an air conditioning system of any building which would flow by gravity over any public property or adjacent private pro- perty shall be carried away by means of conductors. The Building Official may require the air conditioning system waste water be connected to a storm sewer or catch basin, if available. Condensate lines shall be insulated to prevent ' exterior condensation, where such condensation could cause a hazard. Section 609 - 1982 Code. Add to end of paragraph the following sentence: "All tests shall be a minimum of fifteen (15) minutes duration." -6- Section 901 - General-1982 Code., Add to last sentence: "or as invoked by local ordinance." Any electrical, plumbing, air-conditioning, or mechanical contractor ' whose practice includes the design and fabrication of electrical, plumbing, air-conditioning, or mechanical systems, respectively, which he installs by virtue of a license issued under Chapter 489, under Part I of Chapter 553, or under arty special act or ordinance when working on any construction project which has: 1. A value of $10,000 or less and requires: a. An electric service of less than 600 amperes in residen- tial construction and less than 800 amperes three-phase in commercial or industrial construction; or b. A plumbing system of fewer than 125 fixture;; or 2. A value of $100,000 or less~and requires air-conditioning and refrigeration equipment to serve an occupant content of ' fewer than 100 persons. 1
