Ordinance 1982-006 Adopts National Electrical Code 1981 Editiont ORDINANCE N0. 6-82 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 11 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE t ELECTRICAL CODF. FOR THE VILLAGE, BY ADOPTING BY REFERENCE THERETO 1'IiE NATIONAL ELECTRIC CODE, 1981 EDITION, AND SETTING FORTH AMENDMENTS TO SAID NATIONAL ELECTRIC CODE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH FLORIDA: Section 1. Section 11-11 of the Village of North Palm Beach Code is hereby amended to read as follows: "Sec. 11-11. ADOPTED BY REFERENCE -- Under the aut ority o ection orida Statutes, the Village of North Palm Beach hereby adopts by reference thereto the National Electric Code, 1981 Edition, and the recommended amendments of the Palm Beach County Building Code Advisory Board, as the electrical code for the Village. ' There has been for at least ten days last past and shall be during the time that this code is in effect, three copies of such code and recommended amendments kept available for public use, inspection and examination." Section 2. Section 11-12 of the Village of North Palm Beach Code is hereby amended to read as follows: "Sec. 11-12. Any person, firm, or corporation who shall violate a provision of this Ordinance, or fail to comply therewith, or with any of the requirements thereof, shall be guilty of a misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Ordinance is committed or continued, and upon conviction of any such violation, such person shall he punished by a fine not exceeding five hundred dollars ($500.00) or imprisonment for a term not exceeding six (6) months, or by both such fine and imprisonment. -2- ?' ' VILLAGE CLERK /% - 3 - UNIFORM, MINIMUM COUNTYWIDE AMENDMENT TO THE NATIONAL ELECTRICAL CODE, 1981 EDITION AS RECONL^1ENDED BY THE PALM BEACH COUNTY BUILDING CODE ADVISORY BOP.RD a ARTICLE 80 - NATIONAL ELECTRICAL CODE 1981 EDITION - IS CREATED 'I'0 READ: ARTICLE 80 - ADMINISTRATION SECTION 90-1 - TITLE AND SCOPli 80-1 (a) Title The provisions embraced within the following chapters and sections shall constitute and be known and cited as "Electrical Cocle" 80.1 (b) Cocle Remedial This code is hereby declared to be remedial and shall be construed to secure the beneficial interest and purposed thereof, which are health, sanitation, general public safety and welfare; by regulating installation and maintenance of all electrical equipment. 80.1 (c) Scope The provisions of this code shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, applicances, fixtures, fittings and/or appurtenances, thereto. By nothing contained in this section or elsewhere in this code is it to be construed that a permit shall be required under this code for any work involved in the erection, installation, repairing, remodeling and ^iaintenance of elevators, dumbwaiters and moving stairways. Such exception shall not, however, extend to work on conductors atnd equipment for supplying power to Ehe control panels of each elevator, dumbwaiter or moving stainoay.~ ~ 80.1 (d) Maintenance ~ All electrical systems, both existing and new, and all parts thereof, shall be maintained in a safe condition. All devices or safeguards which are required liy this code shall be maintained in good working order. The maintenance of electrical systems shall be the responsibility of the owner or their designated agent. 80.1 (e) Service Equipment It shall' be unlawful for any person to disconnect, alter or tamper with any service equipment; such as service drop, conductors, meters or protective devices owned by a municipal, county or state agency; a company or corporation holding a franchise for electrical current for light, heat and power in the county, except duly authorized agents, licensees or employees of such company or corporation. --1 _ 1 80.1 (f) Definitions Industrial Plant Electrical Maintenance Supervisor. A person regularly employed in an industrial plant to perform electrical work solely on behalf of their employer and only upon the premises of their employer's industrial plant, qualified by training and technical know- ledge to plan, lay-out and supervise electrical work permitted to be done under annual industrial permits. Must be certified as a Master Electrician or an Electrical Contractor. Industrial Plant Maintenance Electrician. A person regularly em- ployed in an industrial plant to perform electrical work solely on behalf of their employer and upon the premises of their employer's in- dustrial plant and under the supervision of. an industrial plant electri- cal caintenance supervisor. Must be a journeyman electrician. Electrician. Is a person who is engaged in the electrical trade or business and who is qualified under the terms and provisions of this code. Electrician Apprentice. Is a person who is engaged in learning the electrical trade by working with and under the supervision of a journey- man electrician who holds a valid certificate of competency and who shall be held responsible for the work of such apprentice. Journeyman Electrician. Is a person qualified by experience and/or education to perform work in the electrical trade. Must be certified by the Palm Beach County Construction Industry Licensing Board- Maintenance Electrician. A person who possesses the qualifications i prescribed in this Section for a "journeyman electrician", but who must be regularly employed to maintain-and make minor repairs to the electrical wiring, apparatus and equipment which is installed, contained, and used upon premises or in the buildings owned, occupied, or controlled by the ~, person by whom the maintenance electrician is employed. Master Electrician. A person who possesses the necessary qualifications ~: training, and technical knowledge to plan, lay-out and supervise the installation of electrical wiring, apparatus or equipment for light, heat, or power, as covered by the terms and provisions of this Article. 2 ~:w~ Section 80-2 - ORGANIZATION 80.2 (a) Electrical Inspection Division There is hereby established a division to be called the I~:lectri.cal Inspection Division, with the Building Department which shall be in the charge of the Official so legally designated by the local governing body. 80.2 (b) Inspectors The Building Official, with the approval of the Chief Appointing Authority, may appoint such number of officers, inspectors, assistants and other employees as shall be authorized from time to time. No person shall be appointed as inspector of. electrical systems who has not had at least five (5) years experience as an electrical inspector, master electrician, journeyman electrician, engineer, or as a superin- tendant, or foreman in charge of electrical constructions. The inspector appointed shall be certified within twelve (12) months of appointment by the Building Officials Association of Florida. 80.2 (c) Restriction on Employees An officer or employee connected with the department, except one whose only connection is as a member of the board established by this code shall not be financially interested in the furnishing of labor, material or appliances for the construction, alteration, or maintenance of elec- trical installations or in the making of plans or of specifications; unless they are the owner of such building. Such officer or employee shall not engage i.n any work which is inconsistent with their duties or with the interest of the department. 80.2 (d) Board of Adjustments and Appeals The Board of Adjustments and Appeals, as established by Section III of the Standard Building Code, shall hear all appeals concerning the interpretation and enforcement of this code. ' SECTION 80-3 - POWERS AND DUTIES OF THE ELECTRICAL INSPECTOR 80.3 (a) Right of Entry The Building Official shall enforce the provisions of this code and may enter any building, structure, or premises to perform any duty imposed by this code. 3 .~ 80.3 (b) Stop Work Orders Upon notice from the Building Official that work on any electrical installation that is being done contrary to the provisions of this code or in a dangerous or unsafe manner, shall be stopped inunediately. Such notice shall be i.n writing, stating the reason therefore, and shall be given to the owner of such property or to their agent, or the person doing the work, and shall state the conditions under which the work may be resumed. Where any emergency exists, oral notice given by the Building Official shall be sufficient followed by notice in writing within forty-eight. (48) hours. 80.3 (c) Revocation of Permits The Building Official may revoke a permit or approval issued under the provisions of this act in case there has been any false statement of misrepresentations as to the material fact in the application or plans on which the permit or approval was based. In all cases permit fees shall not be refunded. 80.3 (d) Unsafe Installations All electrical installations, regardless of type, which constitute an undue hazard to human life, health or welfare-'are hereby declared illegal and shall be abated by repair and rehabilitation or by demolition in accordance with the procedure as outlined in Section 103.4 - Unsafe Buildings, of the Standard Building Code. 80.3 (e) Requirement Not Covered by Code Any requirement necessary for the safety, strength or stability of i an existing or proposed electrical installation,'or for the safety of the occupants of a building or structure, not specifically covered by this code, shall be determined by the Electrical Inspector, subject to 5 the approval of the Building Official. 80.3 (f) Alternate Materials and Alternate Methods of Installations Alternate materials and alternate methods of installations"shall be approved in accordance with this Section by the Building Official. See Section 103.6 of the Standard Building Code for Product Control require- tnents. 4 80.3 (g) Existing Premises In existing buildings or premises in which electrical. installations are l:o be altered, repaired or renovated, the Building Official has discretionary power to premit deviation from the provisions of this Code, provided that such a proposal to deviate is first submitted for proper determination in order that health and safety requirements, as they pertain to electrical installations, shall be observed. 80.3 (h) Evidence of Compliance The Building Official shall require sufficient evidence to enable a judgement: as to whether proposed alternate meets the requirements of this code for safety and health. 80.3 (i) Tests [,Then there is sufficient evidence to substantiate claims for alter- Hates, the Building Official may require testa of compliance as proof to be made by an approved agency at the expense of the applicant. Tests shall be made in accordance with generally recognized standards; however, in the absence of such standards, the Building Official shall specify the test procedure. Tests may be required to be repeated, if at any time, there is reason to believe that an alternate no'longer conforms to the requirements on which its approval was based. 80.3 (j) Liability Any officer or employee, or member of any board, charged with the enforcement of this code, acting for the governing body in the discharge i of their duties, shall not thereby render themselves liable personally and they are hereby relieved from all personal liability for any damage that may occur to persons or property as a result of any act required or permitted in the discharge of their duties. Any suit brought against any officer or employee because of such act performed by them in t:lte enforcement of any provision of this code, shall be defended by the agency until the final termination of the proceedings. Any suit brought against any former employee of an agency for actions, said employee may have taken in the discharge of their duties while employed by said agency, will be defended by the agency.. 5 SECTION 80-4 - APPLICATION FOK PERMIT 80.4 (a) ln~en Required A l,erson, firm, or corporation shall not do or cause to be done, any installations, alterations, repairs or replacement of equipment or systems covered by the provisions of this Code, without first having obtained the proper permit from the Building Official. 80.h (b) Annual Industrial Permits (1) Upon written request to the Building Official, any industrial plant shall be issued an annual permit for electrical work, but only to the extent of permitting reasonable alterations, additions or exten- sions to existing installations of wiring apparatus or equipment in- stalled, contained, or used upon premises or in buildings owned or occu- pied by the person to whom such an annual industrial permit is issued. Such alterations, additions or extensions must be of a minor character and shall be confined to any existing branch circuits and fixtures, apparatus or equipment connected thereto, but shall not include the installation or replacement of service conductors, service equipment or subfced circuits up to the final center of distribution. No altera- tions, additions or extensions shall be made which would place an over- load upon the service conductors, subfeed or branchfeed service conduc- tors, or overload the protective devices through which electrical energy ~: . is applied. ' (2) The payment of an annual fee of one hundred dollars ($100.00) for each calendar year, and permit fees computed c~onthly according to the fee schedule in Section 80-7. / (3) The regular employment of one or more full time electrician, competent in the safe installation, extension, maintenance and repair of industrial electrical systems and equipment, as required by Section 80-1 (4) The right of the Building Official to check the premises of the permit holder at a reasonable time, unless. prohibited by government regulations. (S) T'he performance of all work shall comply with the applicable provisions of this code. 6 80.4 (c) Form L•'ach application for a permit with the required fee shall be filed with the Building Official on a form furnished for that purpose, and shall contain a general description of the proposed work and its location. The application shall be signed by the owner or their authorized agent. 80.4 (d) Drawings and Specifications Ttao (2) sets of plans and specifications, with a complete description of all proposed electrical work, shall be submitted to the Building Official at the same time application is made for a building permi-t, if any. The plans must be legibly drawn or printed to a definite scale, one (1) floor plan being sufficient if i.t can be made to show all t-he proposed electrical work; otherwise, two (2) or more plans shal.].l~e submitted. The plans shall denote calculations for total connected load, the total floor area, the square feet of the building under consideration, the point to which the service connection is to be made, the size of service and the subfeed wires, the location of service switches and center of distribution and the arrangement of circuits showing the number of outlets connected thereto. The plans, if found in order, must be stamped, reviewed for code compliance by the Building Official or. a duly authorized assistant, prior to the electrical permit being obtained, and before any electrical work can be commenced. Copies of all blueprints and drawings of this nature must be filed in the Building Department for safe-keeping and future r.eference,.if required. %~ The installation of wiring, apparatus or equipment for light,_Iteat or power within or attached to any building or premises, whether for private or public use, must be accomplished strictly in accordance faith the plans r. and specifications submitted. Any changes or omissions in the wiring system shown on the plans must first .be approved by the Building Official and such approval noted in writing. All drawings and specifications and accompanying data shall bear the name, signature and address of the designer. 7 Any building or structure other` than one (1) or two (2) family dwellings, and any building upon any farm for the use of any farmer, shall be designed by an architect or engineer legally registered under the laws of the State of Florida, regulating the practice of Architec- f Cure and Engineering, and who shall fix their official seal and signa- Lure and the date of said drawings, specifications and accompanying data, except that any electrical contractor whose practice is the design and fabrication of electrical systems which he installslby virtue of having qualified under State Statutes or any special act or ordinance, when working on any construction project requiring electrical service of less than 600 amps in residential, and less than 800 amps, 3-phase in commercial or industrial, or has a value of $10,000.or less, is not required to register under the provisions of s.s. 471.001-471.039 as a registered engineer. 80.4 (e) Examination of Drawings The Building Official shall examine or cause to be examined each application for a permit and the drawings and specifications which may be filed therewith, and shall ascertain by such examination whether the installation indicated and described is in accordance with the require- ments o£ this code and all other pertinent laws or ordinances. Section 80-5 Permits 80-5 (a) Action on Application 1. If the Building Official is satisfied that`the work described in an application for permit and the drawings and specifications which may be filed therewith conform to the requirements of this code and other pertinent laws and ordinances, a permit shall be issued to the applicant. 2. If the application for permit and the drawings and specifications which may be filed therewith describe .work which does not conform to the requirements of this code or'other pertinent laws or ordinances, the Building Official shall not issue a permit but shall return the drawings to the applicant with the refusal to issue such a permit. Such refusal, shall, when requested, be by letter and shall contain the reasons therefore. 8 80-5 (b) Conditions of the Permit The Building Official shall.act`upon an application for a permit with plans as filed, or as amended, without unreasonable or unnecessary delay. A permit issued shall be construed to be a license to proceed with the work and shall not be construed as authority to violate, cancel, alter or set aside any of the provisions of this code, nor shall such issuance of a pernrit prevent the Building Official from thereafter. requiring a correction of errors in plans or in construction, or of violations of this code. Permits may be issued subject to either of the following conditions: 1) Every permit issued shall become null and void unless the work authorized by .such permit is commenced within ninety (90) days after the time the work is commenced. 2) Prior to issuing the permit, the Building Official and the applicant may establish a maximum time schedule for completion of logical phases of construction under the permit. Such schedule shall take into effect historical data of the governmental agency, for construction of similar structures within the limits of the agency. railure of: permit holder to pursue construction under the permit in accordance with the maximum time schedule shall be prima facie evidence that the building project has not been commenced, or has been suspended or abandoned. Such prima facie evidence shall be in addition to any other evidence that construction under the permit has been commenced or has been suspended or abandoned under the permit. % ~: Should the permit for any reason become null 'and void prior to the work being commenced, it may be subsequently commenced or recommenced and a new permit shall be obtained. A null and void permit may be ,.. renewed for a prorated amouriC of the original fee, provided the proposed work conforms with all requirements, ordinances, rules and regulations effective at the time of such renewal. In every case, a courtesy notice shall be mailed by the Building Official to the permit holder advising that said permit is null and void. 9 A journeyman or master electricign shall actively supervise on the site electrical work. { 8U.5 (c) Qualifications of Applicant Application for permits will be accepted only from contractors currently licensed in their respective field and for whom no revocation or suspension of license i.s existing except that a sole owner may make application for permit and perform the work in connection with the construction, maintenance, alterations, or repair of a single-family residence or tcuo (2) family residence for their own use and occupance and not intended for sale. Such licensed contractor or sole owner shall he held responsible to the Building Official for the proper super- vision and conduct for all work covered thereof. SECTION 80-6 FEES 80.6 (a) General A permit shall not be valid until the fees prescribed in this section have been paid, nor shall an amendment to a permit be approved until the additional fees, if any, shall have been paid. 80.6 (b) Failure to Obtain a Permit If any person commences any work on an installation before obtaining the necessary permit from the Building Official, the permit fee shall be doubled. 80.6 (c) Schedule of Permit Fees 1. General. No permit shall be issued until the fee prescribed under this Section shall have been paid. Nor sha/11 an amendment to a permit be approved until the additional fee, if any, due to the addition- al work, shall have been paid. No refund of permit fees will be allowed a after thirty (30) days from date of issue of the permit. ?. Records. The Building Official shall keep a permanent and accur- ate account of all permit fees and other monies collected, the names of all persons upon whose account the same was paid and the date and amount thereof. 3. Schedule of Permit Fees. On all electrical work requiring a permit as set forth in 80.5, fees shall be paid as required at the time of filing application in accordance with the fee schedule, established by the authority having jurisdiction. 10 A reinspection fee of $10.00 may be charged for each reinspection made due to the rejection of work, or due to the fact that work was not ready at the time specified in the request for inspection, or failure to call for inspection. Payment of such fee must be made prior to the reinspection. Plan Filing Fee - Thirty percent (30%) of estimated permit fee upon filing. Deduct amount from actual fee if permit is obt:ainecl within four (4) months from approval date; if not, permit fee is kept. Major working drawing review fee - One hundred dollars ($100.00) deducted from permit fee if permit is obtained within eight (8) months from submission date. Moor fee changes after plans are approved and permit issued - 1'wo hundred and fifty dollars ($250.00) fee, but in no case more than the original permit fee. ' Major plan rechecking fee - Second (2nd) and additional check lists t:en percent (10%) of permit fee for checking service each time rechecked. 80.7 (a) Inspections 80.7 (a) General 1. Before issuing a permit, the Building Official or authorized agent may examine or cause to be examined, any building or site at or i.n which the work is to be done. All electrical work shall be inspected from time to time during and upon completion of the work #or which a permit is issued. A record shall be made of every such examination and inspection, and of all violations of the code. 2. The Electrical Inspector or authorized agent, upon proper notifi- cation from the permit holder, shall make the following inspection of electrical work, together with such other insp~etions as may be necessary, and shall approve that portion of the electrical work of the stages listed below, or shall notify the permit holder, or agent, wherein the. sarne fails to comply with the requirements of the Code. (a) First inspection: After all the wiring has been run and the panel has been installed and made up, or wire and circuits properly tagged with the number of outlets, before it has been covered, other than to provide required mechanical protection, the inspector shall examine same. 11 He shall make such observations an d[measurements, together with tests, as may be required to determine whether the work complies with the code. Where toiring or circuits have been tagged, in lieu of panel make-up, the tags shall remain until the panel has been finally made up and inspected and approved by the inspector. Inspector may waive the test requirements, provided t:he electrical contractor shows proof to the inspector that installation will comply with code. (3) The Building Official shall make, or cause to be made a final inspection of all electrical work in buildings upon completion thereof, prior to the issuance of the Certificate of Occupancy. (4) No o~,mer or agent shall allow any new building to be occupied by any person until after the electrical work in said building shall leave been approved by the Building Official. No equipment regulated by this Code shall be connected to the power supply and placed in normal operation until it complies with all applicable requirements of this Code and a final inspection approval has been issued. The servicing utility company shall not connect the power supply until notified by the Building Official. 80.8 Violations and Penalties Any person, firm or corporation who shall violate a provision of this code, or fail to comply therewith, or with any of the requirements thereof, shall be guilty of misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of an of the / y plrovisions of this code i.s committed or continued, and upon conviction of any such violation, such person shall be punished by a fine of not less than fifty dollars ($50.00) nor more than five hundred dollars~($500.00), or by imprisonment not exceeding six (6) mottths, or by both such fine and imprisonment. 80.9 Validity . If any section, sub-section, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this code. _ 12 210.1 Scope The provisions of this Article apply to branch circuits supplying lighting or appliance loads or combinations of both. Where motors or motor-operated appliances are connected to any branch circuit that also supplies lighting or other appliance loads, .the provisions of both this Article and Article 430 shall apply. Article 430 applies where a branch circuit supplies motor loads only. Branch circuits sha7.l be plainly marked at the overcurrent protective device so they can be ciuickly and positively identified. 210.50 (d) Any building to be used for other than office occupancies, warehousing purposes or residences shall have receptacles installed each twenty feet (20') of unencumbered wall space. All receptacles shall be installed at accessible locations and this accessibility shall he maintained regardless of wall fixtures or other modifications. Office occupancy shall have receptacles installed each twelve feet (12') of unencumbered wall space. 210.50 (e) All air-conditioning and heating components installed on a roof or in an attic shall have an accessible external disconnect switch and an 110-120 volt A/C grounding type convenience outlet convenient to the general equipment area. 210.52 (g) In each branch circuit panel board of any one and two family dwelling units, there shall be a minimum of two (2) extra spaces for fuse .holders or breakers for future use.
