AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FIARIIk1, PERMITTING
SMOKING IN PUBLIC PLACES AND IN PUBLIC MEETINGS WITHIN THE VILLAGE OF NORTH
PALM BEACH.
WHEREAS, the Board of County Commissioners has passed Ordinance 80-10
' restricting smoking in public places and in public meetings in the unincorporated
areas and in thos incorporated areas of Palm Beach Cowlty which do not have
Ordinances in conflict with Ordinance 80-10; and
WI-IIIZFA.S, the Village of North Palm Beach has determined that
goverrnnental restriction of smoking in public places and in public meetings
is contrary to the public wlefare of the business, residents and visitors
to the Village of North Palm Beach, and believes that such restrictions
and regulations should be done on a private basis and not through government
control;
NOW, THEREFORE, BE IT ORIIAINID BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA:
' Section 1. Within the corporate limits of the Village of North Palm
Beach, no designated smoking areas or designated non-smoking areas shall
be required in any public place or at any public meeting as a matter of law,
and any person may smoke in a public place or at a public meeting without
being in violation of any unnicipal ordinance or coumty ordinance to the
contrary.
Section 2. It is the intent of the Village Council of the Village
of North Palm Beach, Florida, that this Ordinance shall have the effect
of conflicting with Ordinance No. 80-10 of Palm Beach County, Florida,
enacted by its Board of County Commissioners to the extent permitted by
the Florida Constitution, Article VIII, Section 1, and that the provisions
of said Ordinance 80-10 of Palm Beach County, Florida, shall not apply
' within the corporate limits of the Village of North Palm Beach, Florida.
Section 3. It is necessary that this Ordinance be passed on an
emergency basis since the County Ordinance 80-10 had its aclmowledgement
from the Department of State Filed in the Office of the Clerk of the Board
of County Commissioners of Palm Beach County, Florida, on Septenber 8, 1980,
with a purported effective date of September 15, 1980, and the hardship
and damages to businesses and persons in charge of public places and to
the general public within the corporate limits of the Village of North
Palm Beach can be substantial unless this Ordinance is passed on an
' emergency basis.
Section 4. This Ordinance shall take effect iimtediately upon passage.
