AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, AMENDING ARTICLE IV,
"MANAGER," OF CHAPTER 2, "ADMINISTRATION," OF THE VILLAGE
CODE OF ORDINANCES BY AMENDING SECTION 2-115, "RESIDENCY,"
TO ALLOW A MAJORITY OF THE MEMBERS OF THE VILLAGE
COUNCIL TO WAIVE THE VILLAGE RESIDENCE REQUIREMENT;
PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY;
PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 2-115 of the Village Code of Ordinances requires that the Village
Manager attain Village residence within 120 days of his appointment and retain Village residence
during his period of appointment; and
WHEREAS, in order to provide more flexibility, the Village Council wishes to amend
Section 2-115 to allow a majority of members of the Village Council to waive the requirement
that the Village Manager attain and retain Village residence during the period of his or her
appointment; and
WHEREAS, the Village Council determines that the adoption of this Ordinance is in the
interests of the health, safety and welfare of the Village and its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA, as follows:
Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein.
Section 2. The Village Council hereby amends Chapter 2, "Administration," Article IV,
"Manager," of the Village Code of Ordinances by amending Section 2-115 to read as follows

Sec.2-115. Residency.
At the time of his or her appointment the village manager need not be a
resident of the village or state, but shall attain residence within the village limits
within one hundred twenty (120) days of his or her appointment, and retain village
residence during his or her period of appointment, unless waived by an affiii7native
vote of a majority of the village council. A majority of the village council maX
revoke this waiver at any time for any or no reason and if revoked, the manager
shall be required to attain village residence within sixty (60ws or as otherwise
determined by a majority of the council.

Section 3. The provisions of this Ordinance shall become and be made part of the Code of
Ordinances for the Village of North Palm Beach, Florida.
Section 4. If any section, paragraph, sentence, clause, phrase or word of this Ordinances is
for any reason held by a court of competent jurisdiction to be unconstitutional, inoperative or
void, such holding shall not affect the remainder of the Ordinance.
Section 5. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict
herewith are hereby repealed to the extent of such conflict.
Section 6. This Ordinance shall be effective immediately upon adoption.
