AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
AMENDING THE VILLAGE OF NORTH PALM BEACH CODE BY MAKING PROVISION
1'OR THE PRESIDENT PRO TEM TO PRESIDE AT COUNCIL MEETINGS IN THE ABSENCE
OF THE MAYOR AND VICE MAYOR; BY CHANGING A REFERENCE IN THE CODE TO THE
CHIEF OF POLICE TO READ DIRECTOR OF PUBLIC SAFETY; BY PROVIDING
THAT NO PLANTING OTHER THAN GRASS MAY BE PLACED INSIDE RIGHTS -OF -WAY
EXCEPT BY THE VILLAGE; AND BY DECLARING IT UNLAWFUL FOR ANY PERSON TO
PLACE OR ERECT UPON PUBLIC WAYS OR PASSAGEWAYS TO ANY BUILDING AN
OBSTRUCTION OF ANY TYPE.
FLORIDA:
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
Section 1. That Section 2-9(1) of the Village of North Palm
Beach Code is hereby amended to read as follows:
"Sec. 2-9. MEETINGS; PRESIDING OFFICER---(1) The
Mayor shall preside at all meetings, if present,
and in his absence, the Vice Mayor. In the absence
of both the Mayor and Vice Mayor, the President
Pro Tem shall preside."
Section 2. That Section 4-5 of the Village of North Palm
Beach Code is hereby amended to read as follows:
"Sec. 4-5. GENERAL ENFORCEMENT ---The director of
public safety and such other persons as may
be designated by him or the village manager are
hereby authorized and directed to enforce this
Chapter."
Section 3. That Section 24-59(2) of the Village of North Palm
Beach Code is hereby amended to read as follows:
"Sec. 24-59(2). No person shall place or erect
upon public way or passageway to any building
an obstruction of any type; provided that this
subsection shall not prevent the duly authorized
or required placing of temporary barriers or
warning signs for the purpose of safeguarding
the public; and providing further that swale
markers may be placed at the edge of swale areas
to protect the edges of lawns from being driven
on by passing vehicles, with the swale markers
to be round button cement markers with anchor
rods attached, not to exceed 12 inches in diameter
and 4 inches in height."
Section 4. That Section 36-54(6) of the Village of
North Palm Beach Code is hereby amended by changing the last sentence
thereof to read as follows:
"No planting other than grass may be placed
inside right-of-way except by Village."

PLACED ON SECOND, FINAL READING AND PASSED THIS 24 DAY OF SEPTEMBER,
1970.
