ORDINANCE NO. 207-70
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
SETTING FORTH THE VARIETY, LOCATION AND NUMBER OF TREES TO BE
PLANTED IN THE SWALE AREAS OF THE VILLAGE OF NORTH PALM BEACH,
FLORIDA.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. As used in this Ordinance, the term "swale
areas" shall mean those areas lying between the street and the
sidewalk which are the property of the Village of North Palm Beach
as part of its road and drainage right-of-way.
Section 2. No trees shall be removed or planted in the
swale areas except by the Village of North Palm Beach or by private
citizens who have obtained the written approval of the building in-
spector of the Village of North Palm Beach to plant or remove any tree.
Section 3. The following regulations shall govern the
variety and location of trees planted in swale areas:
(a) Only those trees set forth on Exhibit 1 to this
Ordinance may be planted in any swale area, and the notations as to
plats and streets on Exhibit 1 shall be followed as to description
and species.
(b) Trees shall be planted at least five feet from the
sidewalk except on cul-de-sac areas.
(c) There shall be no more than two trees planted per
lot frontage. In cases where one tree is planted on the lot frontage,
it shall be located near the center of the lot frontage.
Section 4. The terms of this Ordinance shall apply to all
new plantings in swale areas and the Village Manager shall undertake
a program to make all nonconforming tree plantings existing as of the
date of this Ordinance conform to the plantings set forth on Exhibit 1

over a period of time not to exceed seven years from the date of
passage of this Ordinance. However, no plantings existing as of the
date of this Ordinance may be removed without the permission of the
property owner adjacent to the swale within five years of the date of
this Ordinance unless the planting is interfering with drainage or
utility lines.
Section 5. Any person violating the provisions of this
Ordinance shall, upon conviction thereof, be punished by a fine
not to exceed Five Hundred Dollars or by imprisonment not to exceed
sixty days, or by both such fine and imprisonment.
