WHEREAS, the Charter of the Village provides in Article V, Section 29, as follows: "Upon petition of the owner or owners of any lands adjoining or within two (2) miles of the territorial boundaries of said municipality, to annex such lands by ordinance to the territorial limits of the municipality hereby established. Whenever any land shall be annexed to the municipality hereby established. upon the petition of the owner or owners thereof and in accordance with the power and authority hereby given, then such land so annexed shall be and become a part of the municipality hereby established with the same force and effect as though the same had been originally incorporated in the territorial boundaries thereof." and WHEREAS, the following petition has been received by the Village Council: "Village Council Village Hall North Palm Beach, Florida Gentlemen: Mr. and Mrs. Marshall J. Benjamin hereby request annexation of property to the Village of North Palm Beach. A survey of this property, on which North Palm Beach Pri- vate School operates, will follow for your information. Very truly yours, /s/ Marshall J. Benjamin /s/ Nancy Benjamin and WHEREAS, it appears that said land is owned by said persons and is geographically so located as to comply with the Charter provisions above quoted and should be annexed by the Village: NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA: Section 1. The following land in Palm Beach County, Florida, be and is hereby annexed to the Village of North Palm Beach, Florida: A tract of land in Lots 3 and 4 of a subdivision of Government Lot 8, Section 4, Township 42 South, Range 43 East, Palm Beach County, Florida, according to the plat thereof, recorded in Plat Book 18, Page 4, Public Records of Palm Beach County, Florida, said tract of land being more particularly described as follows: Begin at the point of intersection of the North right -of way -line of McLaren Road with the east right-of-way line of Ellison -Wilson Road, said point being the Southwest corner of Lot 3; thence run N.3°04"10"W. along the East right-of-way line of Ellison -Wilson Road 303.89 feet to the Northwest corner of the said Lot 3; thence run 3.89°54'55"E., along the North line of Lot 3 and continue along theNogth line of Lot 4, 693.61 feet; thence run South 130.0 feet; thence run N. 8954'55"W., 100.0 feet to a point in the West Line of the said Lot 4; thence run South along the West line of Lot 4, 172.53 feet to a point in the North right- of-way line of McLaren Road; thence run West along the North right -of -wag line of McLaren Road, 210.0 feet; thence run North 152.84 feet; thence run N. 89 54155"W., 157.33 feet; thence run South 153.06 feet to a point in the North right-of-way line of McLaren Road; thence run West 210.0 feet to the point of beginning. • ORDINANCE NO. 108 Page -2- Section 2.
