ORDINANCE N0. 92
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH CREATING A PLANNING AND ZONING ADVISORY
BOARD; SETTING FORTH ITS DUTIES AND COMPOSITION; AND REPEALING CONFLICTING RESOLUTIONS.
WHEREAS, a needexists in the Village for a Planning and Zoning Advisory Board to advise
the Village Council regarding annexation, zoning, long range and master planning and other matters
relating to over-all development of the Village;
follows:
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA as
SECTION 1. PRIOR RESOLUTION SECTION REPEALED. _
Section 1 of Resolution #25 is hereby repealed.
SECTION 2. VILLAGE PLANNING AND ZONING COMMITTEE - CREATION; COMPOSITION:
a) There is hereby, established a planning and zoning advisory board to be hereafter
known as the Village Planning and Zoning Advisory Board.
b) Said Board shall be composed of seven (7) members who. shall be resident free-
holders of the Village; the members shall hold office for a term of two (2) years from the date
of appointment, except the initially instituted Board which shall have four (4) members holding
office for two (2) veers and three (3) members holding office for one (1) year from date of
appointment; provided any member may be removed at any time by a majority vote of the Village
Council and further provided, that in the event of a vacancy the Village Council shall appoint a
successor to the vacancy to serve for the remainder of the term so left vacant; and member shall
be eligible to succeed himself.
c) The Village Building Official shall sit as an ex-officio member of this Board
SECTION 3. SAME - POWERS AND DUTIES
a) The Planning and Zoning Board shall be advisory to the Village Council and shall
have no official powers, except those specifically prescribed in this Section, and shall be
deemed to be, in all events and in all transaction, directly under the supervision of the -Village
Council, which shall have power to alter, modify or change any action or ruling of said Board.
b) At the first meeting after the new Board members take office each year they shall
elect from among their members a Chairman, Vice -Chairman and Secretary; such officers may succeed
themselves.
c) Meeting of said Board shall be held at the call of the Chairman or at such other
times as the Board may determine but in no event shall the Board meet less than once a month.
Meetings of the Board shall be open to the public and the time and place of the meetings shall
be announced sufficiently in advance to notify the public. Board shall keep minutes of its
official actions, all of which shall be promptly filed in the office of the Village Clerk and shall
be a public record. Such Board may establish any rules and regulations and order of business it
may deem necessary in the conduct of its meetings.

d) All requests made to the Village Council involving annexation, zoning, re -zoning,
commercial development, sub -divisions and residential development, long range and master planning shall
be referred to the Board for study and recommendation. The Board may request any parties involved or
affected by its investigations to appear before the Board in order to discuss the matter more fully
and to acquire all facts necessary to reach a final recommendation. In its discretion, the Board shall
have the power to include as conditions in its recommendations that the right to be granted shall be
personal to the applicant, and that the same must be exercised within a reasonable time, else the same
will become void, or may recommend any other reasonable limitation as a condition precedent to such
grant by the Village Council.
The Village Council in acting upon such recommendations shall not be bound thereby, but shall
give consideration to all such recommendations and determine the same as in the judgment of the
Village Council shall be to the best interests of the public health, safety, comfort, morals, or general
welfare of the inhabitants of the Village, or for the best government of the Village.
e) It shall also be the duty of the Board to make studies and recommendations for the improve-
ment of the over-all general plan of the Village, with a view to the present and future growth and develop-
ment of the Community, movement of traffic, the convenience, health, recreation, general welfare, and
other needs of the Village dependent on the general plan of the Village; to consider public highways,
lands buildings, bridges, and all other public places and structures, additions to and alterations in
those already existing, and the layout or platting of new subdivisions of the Village.
f) The Board may of its own volition report to the Village Council with recommendations on
any matter which in the opinion of the Board affects the growth, plan or zoning of the Village.
g) The Board shall have the power to call upon any branch, official or employee of the
Village government for information and advice which in the opinion of the Board will insure the
efficiency and reliability of its work.
h) Any matter referred by the Village Council to the Board shall be acted upon by the Board
within thirty (30) days of the date of reference, unless otherwise specifically stated.. The Boardts
recommendations to the Council shall be in writing and shall state the basis or reasons for its
recommendations.
i) The Board shall submit to the Village Council an annual report on or before January 1 of
each year summarizing the activities of the Board for the Calendar year and the action of the Council
during the year on any and all recommendations made by the Board in that or former years.
First Reading the 12 day of May, 1964.
Second, Final Reading and Passage the 12 day of May, 1964.
