2005-04 Deletes Prohibition Against Home OccupationsORDINANCE 04-2005
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH,
• FLORIDA, AMENDING SUBSECTION F OF SECTION 45-36, GENERAL PROVISIONS, OF
ARTICLE III, DISTRICT REGULATIONS, OF APPENDIX C-ZONING OF THE CODE OF
ORDINANCES OF THE VILLAGE DELETING THE PROHIBITION AGAINST HOME
OCCUPATIONS WITHIN DWELLINGS LYING WITHIN ZONING DISTRICTS R-1, SINGLE-
FAMILY DWELLING DISTRICT, R-2, MULTIPLE-FAMILY DWELLING DISTRICT, AND R-3,
APARTMENT-DWELLING DISTRICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR
THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. Subsection F of Section 45-36, General Provisions, of Article III, District
Regulations, of Appendix C-Zoning of the Code of Ordinances of the Village is hereby amended
to read as follows:
"F. No business, professional, or commercial activity shall be conducted upon any
portion of real property zoned R-1 single-family dwelling district, R-2 multiple-
family dwelling district and R-3 apartment dwelling district or within any dwelling
thereon or upon a dock, pier or other waterside structure appurtenant thereto and
attached to such real property, other than as provided by Section 17-2."
Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for
any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not
affect the remainder of this Ordinance.
Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 4. This Ordinance shall take effect immediately upon passage.
