2005-12 Amends Code - Noise ControlORDINANCE 12-2005 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 19-120, EXEMPTIONS, OF ARTICLE VI, NOISE CONTROL, OF CHAPTER 19, OFFENSES AND MISCELLANEOUS PROVISIONS, OF THE CODE OF ORDINANCES OF THE VILLAGE, WHICH AMENDMENT IS FOR THE PURPOSE OF PROVIDING ADDITIONAL EXEMPTIONS TO ARTICLE VI, NOISE CONTROL; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. Section 19-120, Exemptions, of Article VI, Noise Control, of Chapter 19, Offenses and Miscellaneous Provisions, of the Code of Ordinances of the Village, is hereby amended to read as follows: "Section 19-120. Exemptions The following are exempt from the operation of this article: (1) All public parks, schools, playgrounds and recreation areas specifically designated for such activity in performance of that activity. (2) All equipment tests required by law. (3) All procedures or processes required by law. (4) All accidental soundings of equipment or mechanical failure of equipment making noise prohibited in this article. (5) All emergency backup equipment operating during a declared state of emergency or extended power outages. (6) Operation of emergency backup equipment for testing and maintenance. Testing and maintenance operations shall be prohibited on weekends, national holidays, and between the hours of 4 p.m. and 10 a.m. weekdays; provided, that maintenance and testing operation of emergency backup equipment shall not exceed 74 dBA in any zoning district." Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall take effect immediately upon passage.
