DECLARATION OF EX PARTE COMMUNICATIONS C. PUBLIC HEARINGS AND QUASI-J UDICIAL MATTERS 1. PUBLIC HEARING AND ADOPTION OF AD VALOREM TAX MILLAGE RATE ORDINANCE AND BUDGET ORDINANCE establishing and adopting an ad valorem tax millage rate for the fiscal year commencing 10/1/09 and ending 9/30/10; adopting a budget for the fiscal year commencing 10/1/09 and ending 9/30/10. Mayor publicly announces: (1) rolled back rate (7.4114); (2) percentage decrease under rolled back rate (6.9(1/0); (3) millage rate to be levied (6.90). Council vote on motion to adopt enact Ordinance 2009-13 (Millage) on second reading. ACTION: UNANIMOUSLY APPROVED (Motion/Eissey, Second/Manuel) Council vote on motion to adopt enact Ordinance 2009-14 (Budget) on second reading. PUBLIC HEARING AND 2ND READING OF ORDINANCE 2009-15 — ANNUAL FIRE INSPECTION AND PLAN REVIEW FEES Consider a motion to adopt and enact on second reading Ordinance 2009-15, amending Chapter 12, Fire Prevention and Protection, of the Code of Ordinances to reflect the current edition of the Florida Fire Prevention Code, provide for the establishment and collection of fees for plan review and inspection, and allow for the adoption of fee schedules by resolution. ACTION UNANIMOUSLY APPROVED (Motion/Manuel, Second/Hernacki) D. CONSENT AGENDA The Consent Agenda is for the purpose of expediting issues of a routine or pro -forma nature. Councilmen may remove any item from the Consent Agenda, which would automatically convey that item to the Regular Agenda for separate discussion and vote. 1. Receive Minutes of Golf Advisory Board meeting held 8/10/09 2. Receive Minutes of Recreation Advisory Board meeting held 9/8/09 ACTION UNANIMOUSLY APPROVED (Motion/Manuel, Second/Eissey) E. OTHER VILLAGE BUSINESS MATTERS 1. RESOLUTION — CODE ENFORCEMENT BY CITATION — CODE SECTIONS AND PENALTY SCHEDULE Consider a motion to adopt a proposed resolution designating the code sections to be enforced by citation and establishing a schedule of penalties. ACTION UNANIMOUSLY APPROVED (Motion/Eissey, Second/Manuel) 2. RESOLUTION — ANNUAL FIRE INSPECTION FEES AND PLAN REVIEW FEES Consider a motion to adopt a proposed resolution establishing annual fire inspection fees and plan review fees. ACTION UNANIMOUSLY APPROVED (Motion/Manuel, Second/Aubrey) 3. RESOLUTION — LEASE AGREEMENT — TENNIS PRO SHOP SERVICES Consider a motion to adopt a proposed resolution approving the Lease Agreement with Tennis and More, LLC to conduct tennis pro shop services at the Village Tennis Center. ACTION AMENDED: pg 1, Sec 1, Premises; pg 5, Sec 10.C, Insurance/ Commercial General Liability (Motion/Manuel, Second/Aubrey) UNANIMOUSLY APPROVED (Motion/Manuel, Second/Eissey) F. ADJOURNMENT If a person decides to appeal any decision by the Village Council with respect to any matter considered at the Village Council meeting, he will need a record of the proceedings, and for such purpose he may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. This agenda represents the tentative agenda for the scheduled meeting of the Village Council. Due to the nature of governmental duties and responsibilities, the Village Council reserves the right to make additions to, or deletions from, the items contained in this agenda.
