A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, APPROVING A MINOR AMENDMENT TO THE
BENJAMIN SCHOOL PLANNED UNIT DEVELOPMENT FOR THE
INSTALLATION OF FOUR PLAYGROUND SHADE STRUCTURES AND THE
REPLACEMENT OF AN EXISTING MONUMENT SIGN; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, through the adoption of Ordinance No. 2013-06 ("PUD Ordinance") on March 28, 2013,
the Village Council created The Benjamin School Planned Unit Development ("PUD") and provided
for the development of the PUD in accordance with the plans, specifications, waivers and conditions
referenced therein; and
WHEREAS, through the adoption of Ordinance No. 2017-10 ('*PUD Amendment Ordinance") on
July 27, 2017, the Village Council approved a major amendment to the PUD to reinstate the prior
approval of the proposed Maintenance Facility and change its configuration and to add a two-story
13,171 square foot Science, Technology, Engineering and Mathematics Building (`'STEM Building")
to the existing campus; and
WHEREAS, through the adoption of 2019-03 on April 25, 2019, the Village Council approved a
minor amendment to the PUD to reflect as -built conditions on the Property; and
WHEREAS, through the adoption of Ordinance No. 2025-08 ("Second PUD Amendment
Ordinance") on April 24, 2025, the Village Council approved a second major amendment to the PUD
to (1) add an adjacent .093 acre parcel to the PUD and extend the pick-up/drop-off loop; (2) demolish
the existing Administrative Office building and construct a new Administrative Office building; (3)
remove the unconstructed Maintenance Facility from the approved Site Plan; and (4) reconstruct a
portion of the parking with the McLaren Road right-of-way; and
WHEREAS, Section 8 of the PUD Ordinance provides that the Village Council may approve minor
modifications to the PUD by resolution without necessity of review by the Planning, Zoning and
Adjustment Board, advertisement or public hearing; and
WHEREAS, The Benjamin Private School, Inc., property owner, is requesting minor modifications
to the PUD to install four playground shade structures and to replace an existing monument sign on
the former bank parcel; and
WHEREAS, the Village Council determines that these requests meet the definition of minor
amendments to the PUD and that the adoption of this Resolution is in the best interests of the residents
of the Village of North Palm Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA as follows:
Section 1. The foregoing recitals are ratified as true and incorporated herein.

Section 2. As authorized by Section 8 of Ordinance No. 2013-06, the Village Council hereby
approves the following minor modifications to the Benjamin School PUD:
A. Installation of the following four shade structures manufactured by Shade Systems, Inc. in the
locations depicted on the previously approved site plan attached hereto and incorporated
herein by reference:
Two fifteen foot (15') by fifteen foot (15') aquatic blue offset single -post pyramid
umbrellas for the preschool playground;
2. One thirty-five foot (35') by thirty-five foot (35') mega span playground shade
structure for the preschool playground over existing play equipment; and
3. One twenty foot (20') by twenty foot (20') aquatic blue offset single -post pyramid
umbrella for the lower school playground.
B. Installation of a new monument sign to replace the existing monument sign located at the
southeast corner of McLaren Road and U.S. Highway One on the former bank parcel with a
new 72" by 102" internally illuminated aluminum monument sign and additional landscaping
in accordance with the signed and sealed Sign Plan (North/South Elevation) dated November
3, 2025 prepared by Signarama.
Section 3. To the extent not expressly modified herein, all other provisions of the PUD
Ordinance, the PUD Amendment Ordinance, the Second PUD Amendment Ordinance and all prior
minor PUD modifications shall remain in full force and effect.
Section 4. This Resolution shall take effect immediately upon its adoption.
