ORDINANCE N0. 56
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH COUNTY,
FLORIDA, REGULATING THE OPERATION OF REFRIGERATION MACHINERY, COMPAESSOFi5, AIR
CONDITIONERS, AND OTHER NOISY MACHINERY, BY PROVIDING THAT COMPLAINTS OF SUCH
NOISY MACHINERY SHALL BE MADE TO THE VILLAGE BUILDING OFFICIAL FOR TTS DETER-
MINATION.

WHEREAS, it is in the best interest of the Village of North Palm
Beach, Florida, in order to promote the general welfare of the Village, to
prohibit the unreasonable disturbance of its citizens and residents in the
normal use of the properties used as a place of abode and a home; and
WHEREAS, it is in the general welfare of the Village to prevent dis-
turbances calculated to destroy property valuations and to maintain the proper-
ty values within the Village;
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF NORTH PALM BEACH, FLORIDA, .4S FOLLOWS:
Section 1. A1I automatic, semi=automatic, or manually controlled
refrigeration machinery, compressors, and air conditioning units which emit
noise in the operation thereof shall be installed and operated either within
the confines of the building served by such equipment or, if placed outside of
said building, shall be sound-proofed to the extent that the operation of such
machinery will not disturb persons residing in the vicinity thereof in the
normal use of their property.
Section 2. Upon complaint either by a property owner in the
Village or by a Village Official, the Village Building Official shall make a
determination as to whether such refrigeration machinery, compressors, or air
conditioning units emit such noise as to be considered a nuisance, and if such
determination is made by the Village Building Official, then the machinery
determined a nuisance shall be either repaired if such repair is possible, or
removed so that it shall no longex_be a nuisance.
Section 3. This ordinance shall take effect upon its passage
and approval according to law.
