ORDINANCE # 51
AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, PALM BEACH
COUNTY, FLORIDA AMENDING ORDINANCE NO. 13 PASSED AND ADOPTED MARCH 25,
1957, AS AMENDED, BY AMENDING SECTION 10 THEREOF BY MODIFYING THE PEN-
ALTIES TO BE IMPOSED FOR ENGAGING IN BUSINESS WITHIN THE VILLAGE WITHOUT
AN OCCUPATIONAL LICENSE; BY AMENDING SECTION 11 THEREOF TO PROVIDE FOR
A MORE DETAILED, COMPREHENSIVE SCHEDULE OF LICENSE TAXES TO BE LEVIED
UPON THE VARIOUS BUSINESSES, PROFESSIONS, AND OCCUPATIONS BEING CARRIED
ON WITHIN THE CORPORATE LIMITS OF THE VILLAGE BY PROVIDING FOR AN EFFECTIVE
DATE HEREOF.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH
PALM BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Ordinance No. 13, entitled, "AN ORDINANCE OF
THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORTDA, LEVYING
AN OCCUPATIONAL LICENSE TAX UPON EACH AND EVERY BUSINESS, PROFESSION, and
OCCUPATION ENGAGED IN OR CARRIED ON, WHOLLY OR IN PART, WITHIN THE COR-
PORATE LIMITS OF THE VILLAGE; PROVIDING REGULATIONS FOR THE COLLECTION
OF SUCH LICENSE TAX, INCLUDING PENALTIES; AND FOR OTHER PURPOSES", be,
and the same is hereby, amended as follows:
Section 10 thereof is hereby amended to henceforth read as
follows:
"Section 10. It shall be unlawful for any person to engage in
any trade, business, profession, or occupation within the Village without
a license or upon a license issued upon false statements made by any person,
or in his behalf. Any person engaged in any trade, business, profession or
occupation within the Village without a license or under a license issued
upon false statement by such person, or in his behalf, shall and is hereby
required to pay the following penalties in addition to the license fees
hereinabove provided for:"
After January 15th - 20% of license fee
"In addition to the foregoing penalties hereinabove provided for,
any person engaged in any trade, business, profession or occupation within
the Village without a license or under a license issued upon false state-
ment made by such person, or in their behalf, shall upon conviction thereof,
be punished by a fine of not exceeding Five Hundred Dollars ($500) or by
imprisonment not exceeding sixty (60) days, or by both such fine and im-
prisonment."
"In any prosecution under this ordinance, the fact that such
person is open for business, shall be prima facie evidence of engaging
in such trade, business, profession or occupation, and the burden shall be
upon the defendant to rebut the same."
Section 11 thereof is hereby amended to henceforth read as follows:
"Section 11. The amount which shall be paid by the several firms,
persons or associations engaging in or managing businesses, professions
or occupations for which a license is required are hereby fixed as follows:

rendering service, and whether or not a charge is made
for play. Example: Marble Boards.)

PROVIDED, however, that the following machines
are and shall be exempt from license hereunder:
(A) Machines vending cigarettes, postage stamps,
drinking cups, or unadulterated Florida pro-
duced citrus juice; and
(B) Parcel checking lockers and toilet locks
used in hotels and restaurants.
(2) No Licenseshall be required for any of the machines
listed above, where the entire proceeds of such
machine is used for recognized charitable or benevo-
lent purposes.
Coin operated machines for .amusement or trade or
service purposes not herein specifically classified
shall pay such tax as shall be determined from time
to time, by the Tax Collector, on a basis comparative
with other coin operated or vending machines.

This classification covers every person, firm, corporstion
and/or association operating motor buses, motor trucks,

Village of North Palm Beach which shall have attached thereto
any advertising matter, posters, pictures, cards, or other
advertising matter, advertising any article or business other
than the business of the owner and operator of such vehicles,
and for which the owners and operator of such vehicle charge a
