2025-10 Code Amendment- CT Transitional Zoning Commercial Districtr- ORDINANCE NO. 2025-10 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING APPENDIX C (CHAPTER 45), "ZONING," OF THE VILLAGE CODE OF ORDINANCES BY AMENDING ARTICLE III, "DISTRICT REGULATIONS," SECTION 45-32.1, "C -T TRANSITIONAL COMMERCIAL DISTRICT," TO ADOPT A NEW TABLE OF USES; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the intent of the C -T Transition Commercial Zoning District is to provide for the development of low -intensity residential and business uses and to serve as a transition between strictly residential areas and intense commercial development; and WHEREAS, the table of permitted uses for the C -T Zoning District, formerly the CC Transitional Commercial Zoning District, has not been updated for over twenty-five (25) years; and WHEREAS, Village Staff is proposing to update the list of permitted, special exception, and prohibited uses within the C -T Zoning District to more accurately reflect current uses and market demands and utilize a more user-friendly table format found in other updated commercial zoning districts; and WHEREAS, on March 4, 2025, the Planning, Zoning and Adjustment Board held a public hearing on this Ordinance and provided a recommendation to the Village Council; and WHEREAS, the Village Council determines that the adoption of this Ordinance is in the best interests of the public health, safety, and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing recitals are ratified as true and correct and are incorporated herein. Section 2. The Village Council hereby amends Article III, "District Regulations," of Appendix C (Chapter 45) of the Village Code of Ordinances by amending Section 45-32.1 to read as follows (additional language is underlined and deleted language is str4eke tiff ,,,g ): ARTICLE III. — DISTRICT REGULATIONS Sec. 45-32.1. X ?�C Section 3. The provisions of this Ordinance shall become and be made a part of the Code of the Village of North Palm Beach, Florida. Section 4. If any section, paragraph, sentence, clause, phrase, or word of this Ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional, inoperative, or void, such holding shall not affect the remainder of this Ordinance. Section 5. All ordinances or parts of ordinances and resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Page 3 of 4 Section 6.
