2025-09 Code Amendment-Country ClubORDINANCE NO. 2025-09 AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 9, "COUNTRY CLUB," OF THE VILLAGE CODE OF ORDINANCES BY AMENDING SECTIONS 9-1 AND 9-2 OF ARTICLE I, "IN GENERAL," TO UPDATE THE GENERAL RULES AND REGULATIONS APPLICABLE TO THE NORTH PALM BEACH COUNTRY CLUB AND THE ENFORCEMENT THEREOF; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, at the request of Village Staff, the Village Council wishes to update and clarify the general rules and regulations, including operating hours and prohibitions, applicable to the North Palm Beach Country Club facilities and provide for enforcement thereof, and WHEREAS, the Village Council has determined that the adoption of this Ordinance is in the best interests of the Village and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA as follows: Section 1. The foregoing "whereas" clauses are hereby ratified as true and are incorporated herein. Section 2. The Village Council hereby amends Chapter 9, "Country Club," of the Village Code of Ordinances by amending Article I, "In General," to read as follows (additional language underlined and deleted language stricken thr-o g ): ARTICLE I. IN GENERAL Sec. 9-1. Premises — General regulations. Nor shall any person attach any rope, wire or any contrivance to any tree or plant. A person shall not dig in or otherwise disturb grassy areas or in any other way injure or impair the natural beauty or usefulness of any area. Operation of motorized vehicles and other equipment. a. Operate motorcycles, low speed vehicles, dirt bikes, or all - terrain vehicles (ATVs) at the North Palm Beach Country Club, other than within designated parking areas. (2 3) Hours. Be physically present on: a. The golf course at the Village of North Palm Beach Country Club; during regular golf course play hours if not checked in and engaged in course play. Non -golfers may access the golf course for one (1) hour after sunset and one (1) hour before sunrise each day, but shall not access the tees, greens, bunkers and ponds. Sec. 9-2. Same - Signs; enforcement; penalties. The North Palm Beach Police Department and any North Palm Beach law enforcement officer shall have the authority to enforce sections 9-1 a92 and to arrest any person trespassing upon the country club property or otherwise in violation of the hours of use and other pr-ovisions prohibitions of sections 9-1 and9 2. (c) Waiver. The village manager or the manager's designee may waive the provisions of subsections (2) and (3) during village -sponsored special events at the North Palm Beach Country Club, including, but not limited to, the Fourth of July and the Holiday Boat Parade. Violation of any provision of this Code seetiet article shall be f' punished as provided in section 1-8 of this Code or as otherwise authorized by law, including but not limited to the issuance of a code enforcement citation. Section 3. The provisions of this Ordinance shall become and be made a part of the Code of the Village of North Palm Beach, Florida. Section 4. If any section, paragraph, sentence, clause, phrase, or word of this Ordinance is for any reason held by a court of competent jurisdiction to be unconstitutional, inoperative, or void, such holding shall not affect the remainder of this Ordinance. Section 5. All ordinances or parts of ordinances and resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6.
