Mayor Norris called the meeting to order at 8:25 p.m. All members of Council were present.
All members of staffwere present.
REQUEST FOR INDEMNIFICATION FOR LITIGATION EXPENSES
Discussion was held concerning the request for reimbursement of attorney's fees by former
Country Club Advisory Board member Patricia Unruh. Mr. Knight referred to the letter from the
Village's Insurance Counsel, Anthony Gonzales, which sets forth the reason why no defense was
provided by EMI for Ms. Unruh in the case of Agnolin v. Village of North Palm Beach, et al.
Discussion ensued on holding anattorney-client session regarding this matter. Mr. Rubin
advised that the Council may hold anattorney-client session to discuss only the pending case
between Mr. Agnolin and the Village.
Mr. Knight cautioned against discussing the merits of the pending Agnolin case during Council's
consideration of Ms. Unruh's request.
Consensus of Council was to convene anattorney-client session to discuss pending litigation in
the case ofAgnolin v. Village ofNorth Palm Beach, et al.
Continued discussion on Ms. Unruh's request for reimbursement of attorney's fees will be held
at a date to be determined, a$er the Council meets with its litigation attorney.
VILLAGE PROPERTY INSURANCE PROPOSAL & COMPARISON
Discussion was held concerning engaging an insurance consultant to facilitate a Request for
Proposal process for property casualty insurance.
Mr. Knight reported on a proposal from Don Noel, Noel Insurance Brokers, LLC, representing
Public Risk Management of Florida (PRM) to provide property insurance to the Village. Mr. Knight
• noted that Village purchasing regulations require issuance of a Request for Proposals (RFP) for
purchases over $10,000. Mr. Knight discussed the projected savings under PRM's proposal.

Mr. Knight reviewed windstorm coverage under the current policy with Florida Municipal
Insurance Trust and reported savings of $52,000, as it was determined that a rider to the policy is
not necessary because all Village facilities are more than one-half mile from the Atlantic Ocean.
Mr. Knight recommended against changing insurance carriers at this time. Mr. Knight reported that
the policy with FMIT renews on 10/1/09. Mr. Knight reviewed the penalty for early termination.
Mr. Knight advised that issuance of an RFP and review of the proposals received would necessitate
engaging an insurance consultant at a cost estimated to be between $6,500 and $10,000.
Discussion ensued on implementing a policy that would require obtaining bids or proposals
every three years.
Council discussed seeking reimbursement of previously paid fees for the rider pertaining to
windstorm coverage, using an insurance consultant to seek bids and provide a recommendation,
forming an insurance advisory board or asking the Audit Committee for assistance.
Mr. Knight clarified that the current commitment to FMIT is for one year.
Consensus of Council was to issue an RFP for property, casualty, liability, and workers compensation
insurance next year.
