RESOLUTION NO. 59-81
A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA, ACCEPTING THE BID OF AMERICAN IRRIGATION FOR MODIFICATIONS
TO THE GOLF COURSE IRRIGATION SYSTEM AT NORTH PALM BEACH COUNTRY
CLUB IN THE AMOUNT OF $252,860.00, FROM ACCOUNT NO. 63.1-572-63.14
1981 BOND CONSTRUCTION FUND.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. The bid of American Irrigation, copy of which
is attached to this Resolution, is hereby accepted by the Village
of North Palm Beach in accordance with its terms. The appropriate
Village officials are hereby directed to advise said bidder of this
acceptance. The monies are to be expended from Account No. 63.1-572-63.14
1981 Bond Construction Fund.
Section 2. This Resolution shall take effect immediately
upon passage.

1. Proposed Agenda Title and Description: Consider award of bid for
labor and material for NPBCC Golf Course Irrigation Modifications
2, If Bid Item - Amount Budgeted and Account Number:
63.1-572-63.14 $265,000.
3. Recommendation and Justification: Recommend award of bid to American
Irrigation, North Palm Beach, as the lowest, responsive bidder for modifications
to the golf course irrigation system at the NPBCC in accordance with the
plans and specifications in the amount of $252,860.00. The recommendation
of the Village engineer is attached.
NOTE: The bid of Southeastern Irrigation is considered to be non -responsive
since the required bid bond was not submitted. Bondinc is required since
the funding for this project comes from the BOnd Issue. Financial and
performance recommendations on American Irrigation on file in Clerks office.
4. Eight copies of documents, detailed cost estimates, reaps, etc.,
supporting each should be attached.

THIS BID SUBMITTED TO: Village of North Palm Beach
1. The undersigned BIDDER proposes and agrees, if this Bid is
accepted, to enter into an Agreement with OWNER in the form
included in the Contract Documents to complete all Work as
specified or indicated in the Contract Documents for the
Contract Price and within the Contract Time indicated in
this Bid and in accordance with the Contract Documents.
2. BIDDER accepts all of the terms and conditions of the
Instructions to Bidders. This Bid will remain open for
60_ days after the day of Bid opening. BIDDER will sign
the Agreement and other documents -required by the Contract
Documents within fifteen days after the date of OWNER'S
Notice of Award.
3. In submitting this Bid, BIDDER represents, as more fully
set forth in the Agreement, that:
(a) BIDDER has examined copies of all the Contract
Documents and of the following addenda:

(receipt of all of which is hereby acknowledged)
and also copies of the Advertisement or Invitation
to Bid and the Instructions to Bidders.

(b) BIDDER has examined the site and locality where the Work
is performed, the legal requirements (federal, state and
local laws, ordinances, rules and regulations) and the
conditions affecting cost, progress or performance of the
Work and has made such independent investigations as
BIDDER deems necessary.

This Bid is genuine and not made in the interest of or
on behalf of any undisclosed person, firm or corporation
and is not submitted in conformity with any agreement or
fules of any group, association, organization or
corporation; BIDDER has not directly or indirectly
induced or solicited any other Bidder to submit a false
or sham Bid; BIDDER has not solicited or induced any
person, firm or a corporation to refrain from bidding;
and BIDDER has not sought by collusion to obtain for
himself any advantage over any other Bidder or over

4. BIDDER will complete the Work for the following lump sum

5. UNIT PRICES FOR ADDITIONS OR DELETIONS FROM CONTRACT
For the purpose of determining the Contractor's compensation
for additions or deletions to the project during construction,
the following unit prices for fully installed materials are
hereby offered. The Contract Price will be adjusted up or
down in accordance with the actual installed quantities of

6. The Bidder, if awarded the Contract, agrees to start the work
within _30 calendar days after the date when the Contract
Time commences to run, and agrees to complete the Work within
/50 calendar days after the date when the Contract Time
commences to run.
7. Bidder covenants that he will provide evidence of his quali-
fication to do business in the State where the Project is
located or will obtain such qualification prior to award of
the Contract.

9. The terms used in this Bid which are defined in the General
Conditions of the Construction Contract included as part of
