A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA, AUTHORIZING AND DIRECTING THE VILLAGE MANAGER TO EMPLOY THE LAW
FIRM OF NASON, GILDAN & YEAGER, P. A. TO REPRESENT THE DEFENDANT, VILLAGE
OF NORTH PALM BEACH, A FLORIDA MUNICIPAL CORPORATION, IN THAT CERTAIN
CAUSE ENTITLED "THE STATE OF FLORIDA, EX REL JAMES W. WINTERS, PLAINTIFF,
VS. VILLAGE OF NORTH PAIM BEACH, A FLORIDA MUNICIPAL CORPORATION, DEFENDANT",
FILED IN THE CIRCUIT COURT IN AND FOR PALM BEACH COUNTY, FLORIDA, CASE
NO. 74 2688 CA (L) 01 KNOTT, AND SETTING FORTH PROVISIONS FOR PAYMENT OF
FEES AND COSTS IN CONNECTION THEREWITH.
WHEREAS, the State of Florida ex rel James W. Winters, has
sued the VILLAGE OF NORTH PALM BEACH; and
WHEREAS, said law suit seeks judgment against the defendant
and other relief; and
WHEREAS, because of the above styled law suit and for the
protection of the public health, safety, welfare and property, immediate
legal action must be taken to properly safeguard the rights of the citizens
of the Village of North Palm Beach, to insure the proper defenses of the
above -styled cause, and to insure the legality of the Council's acts in
performing its duties, it is imperative that legal counsel be retained;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH
PALM BEACH, FLORIDA:
Section 1. The Village Manager is hereby authorized and directed
to employ the law firm of NASON, GILDAN & YEAGER, P. A. as legal counsel
to represent the Village of North Palm Beach in that certain cause filed
in the Circuit Court in and for Palm Beach County, Case No. 74 2688 CA
(L) 01 Knott, wherein the State of Florida, ex rel James W. Winters, is
the Plaintiff and Village of North Palm Beach, a Florida municipal corpora-
tion, is defendant, and to employ such additional counsel as may be needed
to adequately and fully defend the legal rights of the defendant. The
Village Manager is further directed to establish budgetary reserves for
the cost of defending said law suit and to pay all reasonable and necessary
costs incurred by the Village of North Palm Beach in connection there-
with.
Section 2. This Resolution shall take effect immediately upon
passage.
