HomeMy WebLinkAboutRes 1974-47 Accepting an Easementh RESOLUTION NO. 47-74 A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, ACCEPTING AN EASEMENT OVER THE WEST TEN FEET OF LOT 22, MARINA ADDITION TO THE VILLAGE OF NORTH PALM BEACH FROM THE ESTATE OF JAMES ROSCHMAN. FLORIDA: BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, Section 1. The Village of North Palm Beach hereby accepts from the Estate of James Roschman that certain easement deed over the West 10 feet of Lot 22, Marina Addition to the Village of North Palm Beach, subject to the conditions set forth therein, a copy of which easement deed is attached hereto and by reference made a part of this Resolution. Elaine Roschman, Executrix of the Estate of E. James Roschman, Deceased, Party of the First Part, her heirs, administrators, executors and assigns, and THE VILLAGE OF NORTH PALM BEACH, FLORIDA, a municipal corporation, its successors and assigns; WITNESSETH: WHEREAS, the Party of the First Part owns and has title to that real prop- erty described below; and WHEREAS the Party of the Second Part desires to maintain an alley for public access across a portion of said property; NOW THEREFORE, the Party of the First Part does hereby grant, assign and set over to the Party of the Second Part, an easement for an alley to he used for public access,described as follow: The West ten (10) feet (as measured parallel and contiguous to the west line) of Lot 22, MARINA ADDITION to the VILLAGE OF NORTH PALM BEACH, accorfi- ing to the Plat thereof on file in the Office of the( Clerk of the Circuit Court, in and for Palm Beath County, Florida, in Plat Book 27, page 98. Roschman, and the Court having determined that it is in the best interest of the Estate that an easement be granted, assigned and set over to The Village of North Palm Beach, Florida, a municipal corporation, its successors and assigns, for an alley to be used for public access, described as follows: The West ten (10) feet (as measured parallel and contiguous to the west line) of Lot 22, MARINA ADDITION to the VILLAGE OF NORTH PALM BEACH, according to the Plat thereof on file in the Office of the Clerk of the Circuit Court, in and for Palm Beach County, Florida, in Plat Book 27, page 98. It is therefore: ORDERED and ADJUDGED that the granting of an easement over the above mentioned real property is confirmed.
