RESOLUTION NO. 1-73
A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PAIN
BEACH, FLORIDA, AUTHORIZING THE MAYOR AND THE VILLAGE CLERK TO ENTER
INTO A CONTRACT WITH THE CITY OF PALM BEACH GARDENS AND THE TOWN OF
LAKE PARK CONCERNING ANIMAL CONTROL AND THE HIRING OF A JOINT ANIMAL
CONTROL WARDEN.
BE IS RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM
BEACH, FLORIDA:
Section 1. The Mayor and the Village Clerk be, and they
are hereby, authorized and directed to enter into that certain Contract
with the City of Palm Beach Gardens and the Town of Lake Park concerning
the hiring of an animal control warden and the purchase of certain
animal control equipment, to be equally divided between the three munici-
palities, a copy of which contract is attached hereto and by reference
made a part hereof.
Section 2. The Village Clerk is authorized and directed
to attach the Village Seal thereto.

AGREEMENT
TIiIS AGREEMENT entered into this 18 day of January
1873, by and between The Village of North Palm Beach, hereafter called "The
Village", the Town of Lake Park, hereafter called "the Town*, and the City of
Palm Beach Gardens, hereafter called "the City."
WHEREAS, the three municipal governments, the Village, the Town
end the City, desire to cooperate with each other in better enforcing animal
control ordinances in their respective communities; and
WHEREAS, the parties have determined that an animal warden and
an appropriate vehicle and other equipment to be shared by and among the

Village, the Town and the City will best accomplish this goal;
NOW , TITEREPOAE , for and in consideration of the covenants and e
agreements hereinafter set forth the parties agree as follows:
1 . The Village shall employ a person to perform the duties of
animal warden in all three communities. Said employee shall be employed under
the conditions of employment of the Village, at a salary to be agreed upon by the
managers of the Village, the Town and the City.
2. The Village shall purchase an animal control vehicle under its
purchasing policies, the size, type and equipment of dame to be decided by the
managera of the Village the Town and the City. Insurance, maintenance and
care of the vehicle shall be in accordance with the normal policies of the Village.
3. The duties and responsibilities of the Animal Warden shall he
to enforce animal control ordinances of the three municipalities party hereto and
to devote time to each of the said municipalities ae equally an is reasonably
(possible. The specific hours and method of work shall be decided by the
mnnagers of the Village, the Town and the City, who shall also designate ona of
their number to directly supervise the Animal Warden. Dispatching anrviee for
'the Animal Warden s1ia11 be provided by the Village, and holding pens for
animals in cuatody shall be provided by the City.
4. The Animal Warden shall refer cases of cruelty to the Animal
Rescue League and shall use said league as an ultimate depository for animals
in custody.
5. All costs of employment of the Animal Warden and coats connected
with the purchase of a vehicle shall be divided equally among the three parties
hereto, at a coat to each party not to exceed $4,000.00 during the fiscal year
1972-1973. No costs shall be charged for supervision, dispatching service or
use of holding pens.
0. In the event of a disagreement among the three managers regarding
administrative decieions to be made in accordance with the provisions of this
contract, the agreement of any two of the three managers shall bind the three
parties; provided, however, that in any event the services of the Animal
Warden shall be divided es equally as reasonably pocsihle between the three
parties hereto.
7. it is contemplated that the essence of this Agreement shall be
continued beyond the terms of this Agreement, and the equipment purchased
hereunder should have usefulness beyond one year. In the event that the
parties hereto or any of them refuse to continue this agreement in future years,
then the remaining equipment shall be sold for the highest and beat bid and the
proceeds derived therefrom divided equally among the parties; provided, however,
that in the event one of the parties desires to pureha ee the equipment at a price
equal to the highest and hest bid for the equipment, then the right of first refusal
shall be given to any municipality that desires to purchase the property at the
highest bid price, and in the event there shall be more than one of the parties
desiring to purchase the property, it shall he determined by lot.

the three municipalities.
