A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA,
AUT]]ORIZING AND DIRECTING THE VILLAGE MANAGER TO EMPLOY THE LAW FIRM OF
NASON, GILDAN & YEAGER, P.A. TO REPRESENT THE DEFENDANTS, VILLAGE OF
NORTH PALM BEACH, FLORIDA, H. MALLORY PRIVETT, JR., MAYOR, RONALD B.
CADBY, VICE MAYOR, ROBERT W. MARTIN, THOMAS B. RHODES AND ROBERT F. SLATER,
ACTING AS AND FOR THE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA,
AND LAWRENCE J. ROBBINS, VILLAGE MANAGER, IN THAT CERTAIN CAUSE FILED BY
FRANK M. SMITH, ET AL IN THE UNITED STATES DISTRICT COURT, SOUTHERN
DISTRICT OF FLORIDA, CASE NO. 72 1256-CIV-NCR, AND SETTING FORTH PROVISIONS
FOR PAYMENT OF FEES AND COSTS IN CONNECTION THEREWITH.
WHEREAS, Frank M. Smith, Thelma F. Smith, Martin Slifka,
Mildred Slifka, Joseph Slifka, Sylvia Slifka and Eli Margolis, as Executor
of the Estate of Morris Brown, deceased, have sued The Village of North
Palm Beach, its Mayor, Vice Mayor, Members of the Village Council and its
Village Manager; and
WHEREAS, said law suit seeks judgment against the defendants
and other relief; and
WHEREAS, because of the above styled law suit and for the
protection of the public health, safety, welfare and property, immediate
legal action must be taken to properly safeguard the rights of the citizens
of the Village of North Palm Beach, to insure the proper defenses of the
above styled cause, and to insure the legality of the Council's acts and
the acts of the Village Manager in performing their prescribed duties,
it is imperative that legal counsel be retained;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH
PALM BEACH, FLORIDA:
Section 1. The Village Manager is hereby authorized and
directed to employ the law firm of NASON, GILDAN & YEAGER, P.A. as
legal counsel to represent the Village of North Palm Beach, its Mayor,
Vice Mayor, Councilmen and Village Manager in that certain cause filed in
the United States District Court, Southern District of Florida, Case No.
72 1256-CIV-NCR, wherein Frank M. Smith, et al are Plaintiffs and The
Village of North Palm Beach, Florida, H. Mallory Privett, Jr., Mayor,
Ronald B. Cadby, Vice Mayor, Robert W. Martin, Thomas B. Rhodes and
Robert F. Slater, acting as and for the Council of the Village of North
Palm Beach, Florida, and Lawrence J. Robbins, Village Manager, et al are
Defendants, and to employ such additional counsel as may be needed to
adequately and fully defend the legal rights of the defendants. The
Village Manager is further directed to establish budgetary reserves for
the cost of defending said law suit and to pay all reasonable and necessary
costs incurred by the Village of North Palm Beach in connection therewith.
PASSED AND ADOPTED THIS 24 DAY OF AUGUST, 1972.
