RESOLUTION NO. 469-70
A RESOLUTION OF TI{E VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA, AUTHORIZING THE MAYOR AND THE VILLAGE CLERK TO EXECUTE A
LEASE BETWEEN THE VILLAGE OF NORTH PALM BEACH AND FIRST PRESBYTERIAN
CHURCH IN NORTH PALM BEACH.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA:
Section 1. The Mayor and the Village Clerk be, and they are
hereby, authorized and directed to execute that certain Lease be-
tween the Village of North Palm Beach and FIRST PRESBYTERIAN CHURCH
IN NORTH PALM BEACH concerning land to be,used for recreational
purposes by the Village, copy of which is attached hereto, marked
Exhibit A and by reference made a part hereof.
Section 2. The Village Clerk is hereby authorized and directed
to affix the Village Seal thereto.

Section 1. - The Mayor and the Village Clerk be, and

Lease between The Village of North Palm Beach and FIRST
PRESBYTERIAN CHURCH IN NORTH PALM BEACH concerning land to be
used for recreational purposes by the Village, copy of which
is attached hereto, marked Exhibit A and by reference made a
part hereof.
Section 2. The Village Clerk is hereby authorized
and directed to affix the Village Seal thereto.

LEASE AGREEMENT

TFIIS LEASE Made this 22nd day of October
1970, by and between FIRST PRESBYTERIAN CHURCH IN NORTH PALM
BEACH, herein called the Lessor, and THE VILLAGE OF NORTH PALM
BEACH, FLORIDA, a municipal corporation organized and existing
under the laws of the State of Florida, herein called the
Lessee,
WITNESSETH, That in consideration of the covenants
herein contained, on the part of' the said Lessee to be kept
and.performed, the said Lessor does hereby lease to the said
Lessee the following described property:
The West 246 feet of the South
354.51 feet of the West 438.39
feet of the East 781 feet of that
part of the Northeast quarter of
the Northwest quarter of Section
17 lying West of the right-of-
way of Prosperity Farms Road,
Township 42 South, Range 43
East, Palm Beach County, Florida;
containing two acres.
TO HAVE AND TO HOLD the same for the term of twenty
(20) years from the lst day of November , 1970,
the said Lessee paying therefor the annual rent of ONE DOLLAR
($1.00), on November 1st of each year during the
term of this lease, upon the terms and conditions hereinafter
set forth.
1. Lessee covenants with the said Lessor to make
no unlawful, improper or offensive use of the premises;
not to assign this Lease or to sublet any part of said
premises without the written consent of the Lessor; not to
use said premises for any other purpose than as a recreational
site; and to quit and deliver up said premises at the end
of said term in as good condition as they are now (ordinary
wear and decay and damage by the elements only excepted).
And the Lessee hereby covenants and agrees that if default
shall be made in the payment of the rent as aforesaid, or
if the said lessee shall violate any of the covenants of
this Lease, then said Lessee shall become tenant at sufferance,
hereby waiving all right of notice, and the Lessor shall be
entitled immediately to re-enter and re -take possession of
the demised premises. -- -
2. During the term of this Lease, Lessee agrees
to maintain the property in a suitable manner and agrees to
use the property for recreational activities only. Lessee
further agrees that it will not install any items or
structures of a permanent nature on said property.
3. If any land filling, grading or installation
of any drainage structure whatsoever are necessary to make
said land suitable for the recreational activities of Lessee,
the aforementioned land work shall be done -by the Lessee
at the Lessee's expense. A sketch of proposed recreational
activities together with any filling,grade of installation
of drainage structures, or of recreation equipment shall
be furnished to the Lessor for its approval, which approval
shall not be unreasonably withheld in view of the terms and
purposes of this Lease. Should no objections be made to
the proposed use of theproperty within 30 days after being
submitted to the Lessor, Lessee may proceed as outlined
on the proposed plans.
4. This Lease may be terminated by either party
upon written notice six (6) months prior to actual termination
date desired.
5. If said Lessee uses the property for any
purpose whatsoever other than for recreational activities,
such action shall constitute automatic termination of this
Lease.
6. Lessee agrees to hold the Lessor harmless
from any damages or expenses to which it may be put by

reason of the Lessee's use of the leased premises,: and
the Lessor shall not be responsible for any damages or
injury occasioned by the negligence or willful, misconduct
of the Lessee or any of its agents or representatives.
