A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH,
FLORIDA, ORDERING BANKERS LIFE AND CASUALTY COMPANY, AN ILLINOIS
CORPORATION AUTHORIZED TO DO BUSINESS IN THE STATE OF FLORIDA,
TO REMOVE CERTAIN FILL PLACED IN THE WATERS OF LAKE WORTH IN THE
AREA OF BIG MUNYON ISLAND (MC ARTHUR ISLAND), WHICH FILL WAS MADE
CONTRARY TO THE PROVISIONS OF ORDINANCE NO. 31 OF THE VILLAGE OF NORTH
PALM BEACH.
WHEREAS, Bankers Life and Casualty Company, an Illinois
corporation authorized to do business in the State of Florida, is
the owner of real property located in the Village of North Palm
Beach consisting of a connection neck between State Road 703 and
Big Munyon Island (McArthur Island), all within the Village of
North Palm Beach; and
WHEREAS, said corporation has filled or permitted to be
filled the waters of Lake Worth in the aforesaid area; and
WHEREAS, such filling was done without compliance with
Ordinance No. 31 of the Village of North Palm Beach, without a
fill permit from the Village of North Palm Beach or from the Corps
of Engineers of the United States Army;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL
OF NORT11 PALM BEACH, FLORIDA:
Section 1. Bankers Life and Casualty Company is hereby
ordered to remove any and all fill in the waters of Lake Worth
placed on the South shore line of the connection neck of land between
State Road 703 and Big Munyon Island (McArthur Island) made since
January 1, 1968.
Section 2. The Village Manager is hereby directed to
inform Bankers Life and Casualty Company of the contents of this
order to remove fill and to report to the Village Council at its
next Workshop Meeting whether the order has been obeyed or not.
PASSED AND ADOPTED THIS 26TH DAY OF MARCH, 1970.
