RESOLUTION NO. 316-67
A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, AUTHOR-
IZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO A ONE-YEAR CONTRACT WITH PARGO,
INC. IN BEHALF OF THE VILLAGE OF NORTH PALM BEACH FOR THE LEASE OF GOLF CARTS AT
THE NORTH PALM BEACH COUNTRY CLUB.
BE IT RESOLVED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA:
Section 1. The Mayor and Village Clerk be, and they are hereby, authorized
to execute a lease with PARGO, INC. for the lease of golf carts by The Village of
North Palm Beach at the North Palm Beach Country Club according to the lease
attached hereto, marked Exhibit 1, and by reference made a part hereof.
Section 2. The Village Clerk is hereby authorized and directed to affix
the Village Seal to said contract.
Section 3.. This Resolution and the Contract adopted hereby shall take
effect as of August 1, 1967.
Section 4. All resolutions or parts of resolutions in conflict herewith
are hereby repealed.
PASSED AND ADOPTED THIS 22 DAY OF AUGUST, 1967.

LEASE AGREEMENT
PARCO, INC., a Florida corporation, the Lessor; and VILLAGE OF NORTH PALM
BEACH, FLORIDA, a municipal corporation organized and existing under the laws of
the State of Florida, the Lessee, each in consideration of the agreements to be per-
formed by the other, hereby on this 22 day of August
1967 agrees:
1. The Lessor hereby leases to the Lessee a rruantity of -ELECTRIC cots -
CARS, hereinafter'referred to as "cars" to consist of a base fleet of 40.cars and
such additional or lesser number of cars as from time to time Lessor and Lesser
shall agree Eire necessary to adequately and properly serve -users of the golf facilities
of the North Palm teach Country Club, North Palm Beach, Florida, tatting into con-
sideration that the number of cars rnust be such as to maintain a proper rental In-
come for the Lessor.
2. The terra .zi this lease shall begin August 1, IS :,? and continue until

3. :he Lessee will pay to the Lessor rent for the property leased during
the term a sure equal to forty-five per cent (455l) of the gross rental income -derived
from the daily rental of said cars to golfers at the North Palm Beach Country Club at
rates agreed upon by Lessor and Lessee.-- Such rents shall be paid on or before the
lst and firth of each month to the Lessor at 600 N. W. llth Avenue, Hallandale,
Florida. -
4. 'the Lessor shall procure and maintain public liability insurance on 'said _
cars in the amount not less than $100,000.00 per person injured or $300,000.00 per
'accident or $10,000.00 per personal property, and shall also maintain fire and theft
insurance on said cars. Certificates of insurance governing said cers-shali be -fur-
nished to the Village Manager of the Village of North Psi,n Beach designating --that .
such insurance is in e;:fect_and Is mailable for the protection of the Lessee:--
5. Lessor, at its own expense, shall furnish all parts and transportation
and labor necessary to effect repairs to said cars. Lessee shall furnish all nec---
essary electricity for charging batteries in said cars.

6. - Lessee agrees with Lessor that it will exclusively use'rental cars or
other golf cars on the property of the North Palm Leach Country Club as are pro-,;__
vided by the Lessor under the terms of this lease, and Lessee_covenants and agrees --
not to compete in any manner with Lessor in connection with the use or rental of golf
cars on the premises of the North Palm Beach Country Club. -
Lessor and Lessee agree that title to all cars furnished to Lessee shad
remain In Lessor's name and Lessee shall not have the right to mortgage, encumber
or otherwise dispose of said cars.
B. Lessor or Its agents may enter, inspect and make such repairs ta_the
leased property as the Lessor may reasonably desire at all reasonable times. In
addition, Lessor may exchange or remove cars when necessary, but prior to ex- -
chenging or removing cars, notice of this shah be furnished to the Country Club
Manager -of the North Palm Beach Country Club in.sufficient time for him to make
any necessary adjustments_to the exchange or -removal of cars. in connection with,
servicing, repairing, exchanging or removing cars, ail of these shall be.cione at
such time and in such manner as to provide minimum interference with the reason-
able use of golf oars by those persons using the facilities of the North Palm Beach Country
Club golf coarse..
9. The Lessor shall furnish and pay an employee of Lessor to seiCle `Y'
end maintain the cars at the North Palm Beach Country Club on the basis of
seven days a week.
10. This ,:Agreement may he amended, altered or changed by written instru-
ment signed by both Lessor and Lessee.
IN WITNESS 1,171-I.E:.EOF the Lessor and Lessee have executed this agreement
for the uses and purposes stated herein.
