HomeMy WebLinkAboutRes 1963-155 Authorizing a Freeholders Election• • • • RESOLUTION NO. 155 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AN ELECTION OF FREEHOLDERS; DIRECTING THE VILLAGE CLERK TO PUBLISH A NOTICE OF A FREEHOLDERS' ELECTION TO BE HELD ON MARCH 19, 1963; NAMING THE TIME AND PLACE WHERE SUCH ELECTION SHALL BE HELD; APPOINTING THE ELECTION OFFICIALS FOR SUCH ELECTION; STATING THE PROPOSITION TO BE VOTED UPON BY THE FREEHOLDERS; AND FOR OTHER PURPOSES. ** WHEREAS, the laws of Florida make provision for the method of calling and holding freeholders' elections under the provisions of Section 6 of Article IX of the Constitution of Florida; NOW, THEREFORE, BE IT AND IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA: Section 1. That an election by the qualified freeholders of the Village to vote upon the proposition hereinafter recited shall be held, and is hereby called and ordered to be held, in the Village of North Palm Beach, Florida, between the hours of 7:00 A.M. AND 7:00 P.M. on the 19th day of March, 1963. Section 2. The Village Clerk is hereby ordered and directed to cause a notice of said election to be posted in at least ten different places within the territorial limits of the Village, and a copy of such notice to be published in the Palm Beach Times, a newspaper of general circulation in the Village, there being no newspaper of general circualtion in the Village, there being no newspaper published within the Village, once a week for four consecutive weeks during the 30-day period prior to said election. Said notice shall be substantially in the following form: NOTICE OF FREEHOLDERS' ELECTION TO BE HELD ON MARCH 19, 1963 TO ALL QUALIFIED FREEHOLDERS RESIDING IN THE VILLAGE OF NORTH PALM BEACH, FLORIDA: By order of the Village Council of the Village of North Palm Beach, Florida, notice is hereby given that a freeholders' election has been called and shall be held in said Village on the 19th day of March, 1963, between the hours of 7:00 A.M. and 7:00 P.M. for the purpose of having said freeholders vote upon the following proposition: • • • • Section 3. The Village Clerk, as registration officer of the Village, is hereby directed to prepare a list of all qualified freeholders appearing on the registration books of the Village, and he shall keep the regustration books open at his office during the hours and days mentioned in the above described notice. A certified list of such qualified freeholders shall be furnished by the Village Clerk to the inspectors and clerk in charge of the polling place on the day of the election. Section 4. The inspectors and clerk of said election are hereby appointed as follows: and , inspectors; and clerk. Said officers are hereby directed to hold said election in accordance with the law and in such manner as to prevent all fraud, deceit and abuse therein or thereto, and to make the returns of such election in the manner prescribed by law. Section 5. At such election, the qualified freeholders shall vote upon the following proposition: PROPOSITION SHALL THE OFFICERS OF THE VILLAGE, IN THE EVENT THE VILLAGE COUNCIL EXERCISES ITS OPTION TO PURCHASE THE PROPERTY HEREINAFTER DESCRIBED, BE AUTHORIZED TO EXECUTE AND DELIVER IN THE NAME OF THE VILLAGE IN CONNECTION WITH SUCH PURCHASE, A MORTGAGE, THE TERMS OF ' WHICH ARE HEREINAFTER DESCRIBED, UPON THE FOLLOWING DESCRIBED REAL ESTATE LOCATED IN PALM BEACH COUNTY, FLORIDA, TO WIT: The East 781 feet of the South 390.5 feet of that part of the Northeast Quarter (NE 1/4) of Section 17, lying West of the Right of Way of Prosperity Farms Road, Township 42 South, Range 43 East, Palm Beach County, Florida; also the East 781 feet of the North 390.5 feet of that part of the Southeast Quarter (SE 1/4) of the Northwest quarter (NW 1/4) of said Section 17, lying West of the Right of Way of Prosperity Farms Road. SAID MORTGAGE AND THE NOTE SECURED THEREBY SHALL BE IN AN AMOUNT NOT EXCEEDING $52,000.00, SUCH MORTGAGE AND NOTE TO BE DATED AS OF THE DATE OF SUCH PURCHASE, TO BEAR INTEREST AT A RATE NOT EXCEEDING 5% PER ANNUM, PAYABLE SEMI-ANNUALLY, THE PRINCIPAL THEREOF TO BE PAYABLE IN ANNUAL INSTALLMENTS OF $8,000.00, BEGINfING ONE YEAR AFTER CLOSING, EXCEPT THAT THE FINAL PAYMENT OF PRINCIPAL SHALL BE IN THE AMOUNT OF $4,500.00, SUCH MORTGAGE AND NOTE TO CONTAIN A PROVISION PERMITTING PREPAYMENT IN ALL OR IN PART AT ANY TIME WITHOUT PENALTY, AND SUCH MORTGAGE AND NOTE TO CONTAIN THE STANDARD AND USUAL OTHER PROVISIONS IN GENERAL USE IN PALM BEACH COUNTY, FLORIDA, INCLUDING PROVISIONS FOR THE ACCELERATION OF THE ENTIRE UNPAID AMOUNT THEREOF IN CASE DEFAULT BE MADE IN ANY OF THE COVENANTS OF SAID MORTGAGE AND NOTE? For Mortgage and Note Against Mortgage and Note • • • • • • Said freeholders' election will be held in the Village of North Palm Beach, and the polling place is designated as the Village Hall in said Village. The polls will be open in the voting place from 7:00 A.M. until 7:00 F.M. The following inspectors and clerk have been designated and appointed by the Village Council for the purpose of conducting said election: Sylvester Zerniko Cathryn L. Mitchell clerk. Ralph J. Cohn and inspectors; and Frances E. Tulino The registration books will be open in the Village Clerk's office between the hours of 10:00 A.M. to 12:00 Noon and 2:00 P.M. to 5:00 P.M. on weekdays only up to and including the time permitted by law for such books to remain open prior to said election. The Village Clerk and election officials are hereby directed to arrange for the use of voting machines at such election, and the form of ballot shall be suchas is consistent with the use of voting machines. If such voting machines, however, are not available, the Village Clerk and election officials should arrange for the use of ballots in the vorm provided by law. Absentee ballots shall, be prepared by the Village Clerk in form consistent with existing Village ordinances. Section 7. Immediately after the closing of the polls on the day of said election, the inspectors and clerk shall certify the returns thereof to the Village Council, and the Village Council shall hold a meeting on•the..19th day of March, 1963, at 8:00 P.M., and a special meeting for that purpose is hereby called, and at such special meeting the Village Council shall canvass the returns of said election and declare the results thereof.
