03-12-2009 VC WS-MMINUTES OF THE WORKSHOP SESSION • VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA MARCH 12, 2009 Present: David B. Norris, Mayor William Manuel, Vice Mayor Darryl Aubrey, Sc.D., President Pro Tem Edwazd M. Eissey, Ph.D., Councilman T.R. Hernacki, P.E., Councilman Jimmy Knight, Village Manager Leonazd Rubin, Village Attorney Melissa Teal, CMC, Village Clerk ROLL CALL Mayor Norris called the meeting to order at 9:10 p.m. All members of Council were present. All members of staff were present. CODE AMENDMENT -OPEN-AIR STRUCTURES Discussion took place concerning a proposed code amendment to permit open-air shade structures within residential azeas and the establishment of building regulations. Mr. Knight advised that current Village zoning regulations do not permit chickee or tiki but type structures. Mr. Knight reported that the Planning Commission discussed this item at its 3/3/09 meeting and unanimously recommended amending the code to allow such structures. Mr. Knight reviewed concerns raised by the Planning Commission, which include setbacks, structure types, and maintenance. Mr. Knight stated these issues could be regulated by ordinance. Mr. Knight advised that the municipalities of Palm Beach Gazdens, Lake Park, Jupiter, Palm Beach, Palm Springs, and Boynton Beach allow chickees and tiki huts, and noted that these types of structures aze provided for in the Florida Building Code. Mr. Knight recommended that open- air shade structures not be limited to only chickees or tiki huts with thatched roofs, and asked Council to consider other types of shade structures, such as ones with metal roofing. Mr. Knight noted that the Village has both thatched roof and metal roof shade structures in its pazks. Discussion ensued on construction, maintenance, and use of structures for storage. It was suggested that gazebos, azbors, and trellises be allowed. Discussion ensued on Section 553.73(9)(1), Florida Statutes, concerning chickees constructed by the Miccosukee Tribe or Seminole Tribe, with regazd to the Village's ability to impose construction regulations. By consensus, Council directed that an ordinance be drafted and sent to the Planning Commission. • This item will come back for Council action after review by the Planning Commission. Minutes of Village Council Workshop Session held March 12, 2009 Page 2 of 2 REGISTRATION FEE FOR NON-DOMICILED BUSINESSES • Discussion was held on establishing a registration fee for persons performing or engaging in business within the Village that is not regulated by the Florida Department of Business and Professional Regulation and against whom the Village is no authorized to levy a business tax. Mr. Knight reported on the review and update of Chapter 17, Licenses and Miscellaneous Regulations, of the Village Code of Ordinances, in order to ensure compliance with Chapter 205, Florida Statutes regarding the levy of business taxes and registration fees. Mr. Knight advised that the Village may levy a business tax on only those businesses located within its municipal limits; however, it may require registration and payment of a registration fee by certain persons engaging in work or performing services within the Village. Mr. Knight proposed a registration fee of $25 to cover administrative costs associated with the registration process. Discussion ensued on the purpose and benefit of registration. Village Planner Jodi Nentwick explained that registration serves a public safety purpose by allowing the Village and its residents to know who is doing work in the Village and identify legitimate businesses or report possible suspicious activity. Mr. Rubin advised that conditions may be imposed on registration, such as requiring proof of insurance, which will protect Village residents. Mr. Knight clarified that the registration fee would be an annual fee. This item was moved forward to the next Regular Session agenda.
