Kelly, Village Clerk Mayor Vastola called the meeting to order at 7:30 p.m. All members of Council were present except Councilman Valente, who arrived at 7:32 p.m. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Vastola gave the invocation, and President Pro Tem Kelley led the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The following Minutes were approved as written: Minutes of Public Hearing (Bill 883) held 4/10/97 Minutes of Public Hearing (Bill 880) held 4/10/97 Minutes of Regular Session held 4/10/97 REPORT OF THE MAYOR Mayor Vastola proclaimed the week of May 5 through May 10,_ 1997 as "Drinking Water Week" in the Village of North Palm Beach. Andrea Pauley of the Seacoast Utility Authority was present to accept the Proclamation. On behalf of the Village Council, Mayor Vastola presented a Certificate of Appreciation and accompanying gift certificates to employee Michael Keith of the Department of Public Services, in appreciation of his 20 years of service to the Village. • • Minutes of Regular Session Held Thursday, April 24, 1997 PETITIONS AND COMMUNICATIONS The following Minutes were accepted for file: Minutes of General Employees Pension Board Meeting held 1/14/97 Minutes of Planning Commission Meeting held 3/4/97 Minutes of Library Advisory Board Meeting held 3/25/97 Minutes of Country Club Administrative Board Meeting held 4/7/97 VILLAGE MANAGER'S REPORT A discussion was held concerning a request for a donation in support of "Project Graduation". Staff was directed to contact Suncoast and Dwyer High Schools regarding their "Project Graduation" program prior to the next meeting. The solicited donations will be placed on the next Regular Session agenda of May 8, 1997. Public Services Director Tom Hogarth reported that the contractor for the Community Center project has offered a credit change order of $6,000 to delete the built-in steps in the new sports lighting poles. Mr. Hogarth asked the Council to authorize staff to negotiate the $6,000 credit on the contract. Vice Mayor O'Meilia moved to authorize acceptance of the $6,000 credit. Councilman Valente seconded the motion, and all present voted aye. Discussion was held concerning letters received from residents who requested a code change to allow utility trailers in R-1 zoning. Councilman Valente moved to send the requests to the Planning Commission for their consideration and recommendation. Vice Mayor O'Meilia seconded the motion, and all present voted aye. Tim Hullihan presented updated site plans for the proposed Public Safety facility. A Special Workshop was scheduled for Thursday, May 1, 1997 at 7:30 P.M. in the Council Chambers. RESOLUTION 26-97 ADOPTED - APPOINTING MEMBERS TO VARIOUS ADVISORY. BOARDS 2 Minutes of Regular Session Held Thursday, April 24, 1997 By written ballot, copies of which are attached to the official Minutes of Record, the Village Council appointed Rob Rennebaum, Margaret Turney and Ed Moore to the Code Enforcement Board; Thelma Obert, James Weis, Diana Christie and Charlotte Chickering to the Library Advisory Board; Kris Garrison, Charles Isiminger, Norman Thomas, Carol Kelley and Robert Bittenbinder to the Planning Commission; Brian Mahoney, Martin Rogol, Joseph Tringali and Kenneth Mays to the Recreation Advisory Board; and Mark Anderson, Martin Chira, Lou Daniello, Curtis Witters and Steve McKalvey to the Zoning Board of Adjustment. Vice Mayor O'Meilia moved to reappoint all incumbents to the Construction Board of Adjustment and Appeals. Councilman Valente seconded the motion, and all present voted aye. By consensus, the Council appointed Dolores Walker as Village Historian. Thereafter, the names of the aforementioned appointees were entered into Resolution 26-97. Councilman Valente left the meeting at 8:50 p.m. due to a family emergency. Vice Mayor O'Meilia moved that Resolution 26-97 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE CODE ENFORCEMENT BOARD, THE CONSTRUCTION BOARD OF ADJUSTMENT AND APPEALS, LIBRARY ADVISORY BOARD, PLANNING COMMISSION, RECREATION ADVISORY BOARD, ZONING BOARD OF ADJUSTMENT, AND APPOINTING A VILLAGE HISTORIAN be adopted. President Pro Tem Kelley seconded the motion, and all present voted aye. BILL 879 - AMENDING CODE FOR VILLAGE MANAGER BENEFITS - PLACED ON FIRST READING President Pro Tem Kelley moved that Bill 879 entitled: AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 2-116 OF 3 • • Minutes of Regular Session Held Thursday, April 24, 1997 ARTICLE IV., MANAGER, OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE TO PROVIDE THAT THE VILLAGE MANAGER WILL BE ENTITLED TO BENEFITS IF REMOVED FROM OFFICE BY THE COUNCIL WITHOUT GOOD CAUSE; ADDING A SECTION 2-118 TO ARTICLE IV., MANAGER, OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE VILLAGE TO PROVIDE THAT THE VILLAGE MANAGER SHALL FURNISH THE VILLAGE COUNCIL EACH FISCAL YEAR WITH A BALANCED BUDGET WITHOUT THE USE OF APPROPRIATED FUNDS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE be placed on first reading and read by title alone. Councilman O'Meilia seconded the motion, and all present voted aye. RESOLUTION 27-97 ADOPTED - AMENDING EMPLOYMENT AGREEMENT WITH. VILLAGE MANAGER President Pro Tem Kelley moved that Resolution 27-97 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN AMENDMENT TO THE EMPLOYMENT AGREEMENT OF THE VILLAGE MANAGER DATED FEBRUARY 17, 1989, ATTACHED AS EXHIBIT "A"; AND, PROVIDING FOR AN EFFECTIVE DATE be adopted. Councilman Norris seconded the motion. During discussion, Village Manager Dennis Kelly told the Council that the annual base salary had been changed on Page 2, Section 6. Salary. to reflect his current annual salary. Additionally, Mr. Kelly noted a change on Page 3, Section 10. Automobile Allowance. whereby the monthly automobile allowance of $250.00 had been changed to $350.00. Councilman Norris moved to amend the first sentence of Page 2, ¶3, Section 7, Performance Evaluation., to read as follows: "The Council may review and evaluate the performance of Employee at least once annually during the month of August. President Pro Tem Kelley seconded the motion. Councilman Norris moved to amend the second sentence of Page 2, 113, Section 7, Performance Evaluation., to read as follows: "Said review and evaluation shall be in accordance with specific criteria developed by Employer in consultation with Employee". President Pro Tem Kelley seconded the motion, and all present voted aye. - Councilman Norris moved to add the words "if any' to the last sentence in 3.B. on Page 3, to read: "They shall generally be attainable within the time limitations as specified, if any." Vice Mayor O'Meilia seconded the motion, and all present voted aye. Councilman Norris moved to amend Page 4, Section 13, Retirement, 1st sentence to read"...transfer or retain ownership in accordance with ICMA-RC Retirement Plan." Thereafter, the motion to adopt Resolution 27-97, as amended, passed 4-0. RESOLUTION 28-97 ADOPTED - AUTHORIZING "BEAUTIFUL PALM BEACHES" GRANT AWARD Vice Mayor O'Meilia moved that Resolution 28-97 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO A HIGHWAY BEAUTIFICATION GRANT AGREEMENT WITH STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ATTACHED AS EXHIBIT "A" WHEREIN THE VILLAGE WOULD INSTALL AND MAINTAIN LANDSCAPING MATERIALS ON U. S. HIGHWAY ONE MEDIANS NORTH OF PARKER BRIDGE AND LOCATED WITHIN THE VILLAGE AND THE DEPARTMENT OF TRANSPORTATION WOULD REIMBURSE THE VILLAGE A PORTION OF COSTS THEREOF NOT TO EXCEED $10,497.50; AND, PROVIDING FOR AN EFFECTIVE DATE be adopted. President Pro Tem Kelley seconded the motion, and all present voted aye. BUDGET TRANSFER FOR SPECIAL LEGAL SERVICES APPROVED 5 • • Minutes of Regular Session Held Thursday, April 24, 1997 Vice Mayor O'Meilia moved to approve a budget transfer in the amount of $37,000 to cover special legal services for various legal issues identified in staff report and RCA dated 4/4/97, from A5540-49911 (Council Contingency) to A5105-33112 (Special Legal Services). Councilman Norris seconded the motion. During discussion, Vice Mayor O'Meilia moved to amend the motion by reducing the amount needed for Ila Feld (cable franchise) from $2,500 to $500, thereby reducing the budget transfer to $34,500. Councilman Norris seconded the motion to amend, and all present voted aye. Thereafter, the original motion, as amended, passed 4-0. SPECIAL LEGAL SERVICES CONTRACT CONFIRMED Vice Mayor O'Meilia moved that the contract for special legal services with Thomas J. Baird be taken from the table. Councilman Norris seconded the motion, and all present voted aye. Vice Mayor O'Meilia moved to confirm the contract between the Village of North Palm Beach and Thomas J. Baird, P.A., in accordance with Art. IV, Sec. 5(i) of the Village Charter. President Pro Tem Kelley seconded the motion. The motion passed 3-1, with Vice Mayor O'Meilia, President Pro Tem Kelley and Mayor Vastola voting aye, and Councilman Norris voting nay. BUDGET TRANSFER APPROVED FOR VILLAGE ATTORNEY LEGAL SERVICES Vice Mayor O'Meilia moved to approve a budget transfer in the amount of $39,000 to fund unanticipated legal expenses exceeding budget estimate; $20,000 from A5540- 49912 (Reserve -Gas Leak) and $19,000 from A5540-49911 (Council Contingency) to A5105-33111 (Monthly Retainer). Councilman Norris seconded the motion, and all present voted aye. HIRING FREEZE LIFTED FOR VEHICLE MECHANIC POSITION, President Pro Tem Kelley moved to lift the hiring freeze on a Vehicle Mechanic 1-Vehicle Maintenance position (job code #5522-0105) in Public Services Department; reference position audit and needs assessment submitted in accordance with the hiring freeze policy. Vice Mayor O'Meilia seconded the motion, and all present voted aye. 6 • • Minutes of Regular Session Held Thursday, April 24, 1997 RECESS The meeting recessed at 9:50 p.m. and reconvened at 10:00 p.m. President Pro Tem Kelley left the meeting due to illness. ANCHORAGE PARK RECREATION BLDG. - CONSTRUCTION/DESIGN PLANS Vice Mayor O'Meilia moved to direct staff to proceed with the bid process on the proposed Anchorage Park Recreation Building. Councilman Norris seconded the motion, and all present voted aye. OSBORNE PARK CONCESSION STAND - CONSTRUCTION/DESIGN PLANS Vice Mayor O'Meilia moved to direct staff to proceed with bid process on the proposed Osborne Park concession stand.
