07-14-1964 VC REG-M 1~1INUTES OF A REGULAR MEETING • of the VILLAGE COUNCIL OF NORTH PALM BEACH held July 14, 1964 ' Present: Harold W, Beery, Mayor Thomas F. Lewis, Vice-Mayor Thomas R, Bell, Councilman Walter E, Thomas, Councilman Herbert Gildan, Village ATtorney Frank R, Spence, Village Manager and Clerk ' Mayor Beery called the meeting to order at 8:00 p,m, and introduced the Reverend George H. Holwager who gave the invocation The Ma or then asked th . y e Clerk to call the roll, all members being present. On motion of Councilman Thomas, seconded by Vice-Mayor Lewis, all members voting aye, the order of business was amended to allow the reading of Resolution N200, appointing Herbert A. SVatt, Councilman, at this time. • On motion of Councilman Thomas, seconded by Vice-Mayor Lewis, all members voting aye, Resolution #200 entitled A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAC,E OF NORTH PALM BEACH, FLORIDA, APPOINTING MEMBER OF THE VILLAGE COUNCIL TO FILL THE VACANCY CREATED BY THE RESIGNATION OF COUNCILMAN HERBERT GIBBON UNTIL THE NEXT GENERAL ELECTION, was adopted, The Village Clerk then proceeded to duly swear in Herbert A. Watt as Councilman and Tax Assessor. The Clerk read the minutes of an adjourned meeting held June 23, 1964, those being approved as amended. ' The Clerk read a letter from the City Council of Boca Raton inviting the Council to an open house and dedication of their new City Hall on July 18, 1964. Mayor Beery read a letter that he had sent to Senator Sepssard Holland objecting to the deepening of Palm Beach Harbor, The Village Treasurer read the financial statements and reports for the Month of June, 1964. The Clerk read a letter from Burnup ~ Sims, Inc,, expressing their desire to secure a franchise from the Village allowing then to install a Community Antenna Television Cable Installation System, They expect to come before the•Council at a later c9ate with a formal proposal. A letter from Mr. Pommy Dunbar, Right-of-Way Agent for Palm Beach County requesting the Village to approve and execute certain Utility Relocation Agree- • ments for the State Road Depari;ment so that they could begin letting bids for the widening and four-Toning of; Northlake Boulevard from F.E,C, Railroad Right- of-Way to U,S.#1. A letter from Mr. Jack Schwencke, Chairman of the North Palm Beach Country Club Board of Governors was read stating that the Ordinance setting up their Board does not require their meeting to be public, however, they will be more ' than happy to hear from any resident or Club member on any subject related to the Club. The Clerk read a recommendation from the Recreation Committee that a boat launching fee be charged at the Village marina due to the great use of it by non-residents. Discussion was scheduled for later in the meeting. The Planning and Zoning Board recommended that the proposed plat of ' Fairhaven Addition 82, submitted by Vince Pappalardo of Fairway Homes, Inc., be approved submect to~the final approval of the Village Engineer, The Board also recommended that the proposed replat and rezoning of Palm Beach Lake Worth Estates owned by Royal American be approved under certain conditions. The Village HaDager recommended that the Council meet with the Planning and Zoning Board to go over the proposal since the Council had never seen the request, The Council agreed to meet the following Tuesday, July 21, Mayor Beery introduced County Commissioner, E. F. Van Kessel, who spoke • about the Palm Beach County World's Fair Exhibit and the need for the Village to contribute towards the cost of the exhibit which twenty-five (25) of the ~. thirty-eight (38) cities in Palm Beach County have already done, They are short $10,000 to $12,000 of their anticipated goal for this year. The matter was taken under consideration, Council Meeting held • Jiliy 14, 1964 page ~- Mayor Beery explained to the public the procedure to be followed during the discussion of the following ordinance in that they would first ' be placed on second reading and then the floor would be opened for comments and objections from the audience and that there would be ample time for discussion. On motion of Councilman Thomas, seconded by Councilman Bell, all members voting aye, Ordinance X95 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DECLARING THE INTENTION TO ' ANNEX A CERTAIN UNINCORPORATED TRACT OF LAND LYING CONTIGUOUS TO THE VILLAGE OF NORTH PALM BEACH IN PALM BEACH COUNTY, FLORIDA, AND DIRECTING THE PUBLICATION OF THIS ORDINANCE. be placed on second reading and read by title only. Councilman Thomas moved and Councilman Bell seconded, that Ordinance N95 be enacted. On discussion, the Village Manager made a presentation on behalf of the Village describing what the proposed annexation entails, benefits to be derived and costs. b1r. Amado Metein, an attorney, representing certain affected property owners spoke in.opposition to annexation and to the ordinance. On motion of Councilman Thomas, seconded by Vice-Mayor Lewis, all members voting aye, Ordinance N96 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM DECLARING ITS INTENTION TO ANNEX A CERTAI] CORPORATED TRACT OF LAND LYING CONTIGUOUS VILLAGE..OF NORTH PALM BEACH IN PALM BEACH FLORIDA, AND DIRECTING THE PUBLICATION OF ORDINANCE. On discussion from the floor, Mr. Richard Burke, an attorney representing Grid, Inc., presented a lengthy objection to being annexed. There being no further discussion, with all members voting aye, Ordinance N96 was en- acted. - On motion of Councilman Thomas, seconded by Councilman Bell, all members voting aye, Ordinance N97 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, DECLARING ITS INTENTION TO ANNEX A CERTAIN DNINCORPORATED TRACT OF LAND LYING CON- TIGUOUS TO THE VILLAGE OF NORTH PALM BEACH IN PALM BEACH COUNTY, FLORIDA, AND DIRECTING THE PUBLICATION OF THIS ORDINANCE. i be placed on second reading and read by title only. Vice-Mayor Lewis moved, Uouncilman Thomas seconded, that Ordinance 897 be enacted. On discussion from the floor, Mr. Richard Burke, attorney also represents owners within this parcel under consideration for annexation, pre- sented a petition signed by some of the land owners stating their objection to being annexed. There being no further discussion, with all members voting aye, ' Ordinance #97 was enacted. On motion of Councilman Bell, seconded by Vice-Mayor Lewis, all members voting aye, Ordinance N98 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ANNEXING CERTAIN LAND. was placed on second reading and read by title only. Upon request of Vice-Mayor Lewis, the Clerk read the first two sections fo this Ordinance to show that ' there were some people who wanted to be annexed to the Village. On motion of Vice-Mayor Lewis, seconded by Councilman Thomas, all members voting aye, Resolution 8201 entitled A RESOLUTION OF THE VILLAGE COUNCIL, NORTH PALM BEACH, FLORIDA, AUTHORIZING THE MAYOR AND VILLAGE CLERK TO ENTER INTO UTILITIES AGREEMENT WITH THE STATE ROAD DEPARTMENT REGARDING THE ADJUSTb4ENT, CHANGE OR RELOCA- TION OF CERTAIN UTILITIES WITHIN THE RIGHT= OF-WAY OF STATE ROAD 809 (NORTHLAKE BOULEVARD). be placed on the agenda and read in full. On motion of Councilman Thomas, seconded by Councilman Bell, all members voting aye, Resolution 8201 was adopted. An original Resolution entitled A RESOLUTION OF THE VILLAGE COUNCIL, NORTH PALM BEACH, FLORIDA, OPPOSING THE DEEPENING AND WIDENING OF PALM BEACH HARBOR; OF THE APPROPRIATION OF PUBLIC MONIES FOR SAID PROPOSAL. was read in full, but after discussion was withdrawn. On motion of Councilman Thomas, seconded by Vice-Mayor Lewis, all members voting aye, Resolution 8202 entitled A RESOLUTION OF THE VILLAGE COUNCIL, NORTH PALM BEACH, FLORIDA, APPOINTING MEMBERS TO THE VILLAGE LIBRARY COMMITTEE. was adopted. ON motion of Councilman Thomas, seconded by Vice-Mayor Lewis, all members voting aye, Resolution 8203 entitled A RESOLUTION OF THE VILLAGE COUNCIL, NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECT- ING THE VILLAGE MANAGER AND CLERK TO SIGN A CERTAIN PLAT. was adopted. Councilman Thomas moved that the requirement for a performance bond be waived in this specific and particular case because of the past ex- perience of the developer, but the motion died for a lack of a second. The Village Manager reported on his conversation with Mr. George Frost regarding an access route to the new Palm Beach Gardens Elementary School and stated that they were in the process of securing right of way to install a road or bicycle path completed before s&hool opens. The Village Manager read a letter from the Library Society asking the Council's permission to utilize the old dining room for the library. On motion of Councilman Thomas, seconded by Vice-Mayor Lewis, all members voting aye, the Library was authorized to move into the old Country Club dining room. On motion of Councilman Thomas, seconded by Councilman Bell, all members voting aye, due to the lateness of the hour and the length of the agenda, that the meeting be adjourned until July 21, 1964, at 8:00 p.m., the meeting adjourn- ing at 11:40 p.m.
