1996-45 Implements Combat Auto Theft Program
ORDINANCE NO. 45-96
AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH PALM BEACH, FLORIDA, ESTABLISHING A PROGRAM
ENTITLED "COMBAT AUTO THEFT" PURSUANT TO SECTION
316.008 (6) OF THE FLORIDA STATUTES; PROVIDING FOR
ADMINISTRATION OF THE PROGRAM; PROVIDING FOR
SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH;
AND, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 316.008, Florida Statutes, which is part of the Florida
Uniform Traffic Control Law, authorizes Florida municipalities to enact ordinances
to establish "combat auto theft" (CAT) Programs whereby motor vehicle owners
may enroll their vehicles and give written consent to law enforcement officers to
stop the enrolled vehicles if they are being operated between the hours of 1:60
• a.m. and 5:00 a.m., provided the CAT decal is properly displayed in the lower left
corner of the enrolled vehicle's left rear window; and,
WHEREAS, the statute authorizes municipalities to charge fees for
administration of the programs, provides that the vehicle owners are responsible
for removing the CAT decals when terminating participation or selling or
otherwise transferring ownership of an enrolled vehicle, and provides immunity
from civil liability for law enforcement officers who stop enrolled vehicles in
accordance with the program requirements; and,
WHEREAS, the Village Council of the Village of North Palm Beach, Florida,
is desirous that the CAT program be established in the Village of North Palm
Beach and administered by Its Director of Public Safety.
BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH,
• FLORIDA:
Section 1. Authority. The Florida Uniform Traffic Control Law authorizes
municipalities to enact ordinances to establish "Combat Auto Theft"
• (CAT) programs whereby vehicle owners may enroll their vehicles giving advance
written consent to law enforcement officers to stop their enrolled vehicles if they
are being operated between the hours of 1:00 a.m. and 5:00 a.m., provided the
CAT decal is properly displayed in the lower left corner of the vehicle's rear
window.
Section 2. Administration of Program. A "combat auto theft" (CAT)
program is hereby established for the Village of North Palm Beach, Florida. The
program shall include:
(A) Consent forms to be executed by motor vehicle owners who enroll
vehicles in the program.
(B) CAT program decals which conform to the specifications, colors and
design of the uniform CAT decal established by the Florida
Department of Law Enforcement for use throughout the state.
(C) All other provisions of the "combat auto theft" program as provided
for in the Florida Uniform Traffic Control Law. Administration
of the program shall be conducted by the Director of Public
Safety of the Village of North Palm Beach.
(D) The Director of Publ ic Safety shall charge a nominal fee for the
administration of the program and the cost of the CAT decal.
Section 3. If any section, paragraph, sentence, clause, phrase or word of
this Ordinance is for any reason held by a Court to be unconstitutional,
inoperative or void, such holding shall not affect the remainder of this
Ordinance.
Section 4. All Ordinances or parts of Ordinances in confi(ct herewith are
• hereby repealed.
Section 5. This Ordinance shall take effect immediately upon passage.
