1996-03 Small Scale Comp Plan Amendment ORDINANCE N0. .03-4h AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, ADOPTING A SMALL SCALE AMENDMENT DESIGNATED AS 96-1 TO THE COMPREHENSIVE PLAN FOR THS VILLAGE OF NORTH PALM BEACH, FLORIDA, IN ACCORDANCE WITH THS LOCAL GOVERNMENT COMPREHENSIVE PLANNING AND LAND DEVELOPMENT REGULATION ACT, AS AMENDED, BEING SECTIONS 163.3161 ET. SEQ., FLORIDA STATUTES, WHICH AMENDMENT IS ATTACHED AS EXHIBIT "A"; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVfi DATE. WHEREAS, pursuant to 163.3161 Et Seq., Florida Statutes, being the local Government Comprehensive Planning and Land Development • Regulation Act, the Village of North Palm Beach may adopt small scale amendments to the Comprehensive Plan; and WHEREAS, the Village Planning Commissions sitting as the local Planning Agency, at its regular meeting held November 7, 1995, made a recommendation to the Village Council to approve the small scale amendment designated as 96-1 and attached hereto as Exhibit "A"; BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The Village Council of the Village of North Palm Beach, Florida, does hereby adopt a small scale amendment designated as 96-1 to the Comprehensive Plan for the Village of North Palm Beach in accordance with the local Government . Comprehensive Planning and Land Development Regulation Act, as amended, which amendment is attached as Exhibit "A" and made a part • hereof. Section 2. If any section, paragraph, sentence, clause, phrase or word of this Ordinance is for any reason held by a Court to be unconstitutional, inoperative or void, such holding shall not affect the remainder of this Ordinance. Section 3. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. Section 4. Small-Scale Amendments Summar The Small-Scale Amendments are summarized (Current Futrure Land Use Plan Designation, Size, Development Status and Proposed Future Land Use Plan Designation) in TABLE 1. Detailed descriptions of each of the Small-Scale Amendments are presented in TABLES 2 - 7, B. Natural Features Anal sis 1. Topography: The elevations of properties associated with Small-Scale Amendments in Planning Area 2 generally range from 20 feet to 25 feet msl, while the elevation of the property in Planning Area 6A is between 5 feet and 10 feet msl. 2. Soils: The soils of properties associated with Small-Scale Amendments in Planning Area 2 are St. Lucie Urban Land Complex. No development suitabilities and limitations ratings are available for this soil type (Ref: Soi~rvev -~- Of Palm Beach Count Area Florida; USDA, 1978) while the soil • type of the property in Planning Area 6A Ys Arents Urban Land Complex. No development suitabilities and limitations are available for this soil type, 3. Veaetation• The land cover maps show the sites of all of the Smal~ le Amendments categorized as Urban. Potential population growth resulting from the Small-Scale Amendments is reduced from 157 residents to 0 residents. • 96-1 .3A, 9~6-1 G3Beand 96a1~,3Cs.areS the result Aofnannexations Hof Benjamin School (a private K - 12 school) properties, prior to the annexation actions, Benjamin School was partially within. the Village of North Palm Beach and partially within unincorporated Palm Beach County. The annexations and resultant Small-Scale Amendments will bring all of the Benjamin School properties under one government jurisdiction, including the uniform application of planning and zoning regulations, as well as eliminate unincorporated area pockets. Portions of the Benjamin School currently under the planning •~ and zoning jurisdiction of the Village have an Educational Future. Land Use Plan designation, as well as an R-2 zoning designation.' Small-Scale Amendment 96-1,2 is the result of an annexation action. The subject property contains an existing commercial facility fronting on U.S. Highway No. 1. Annexation of the subject property assists in eliminating unincorporated area pockets in Village Planning Area 2, as well as being compatible with the commercial nature of the U.S. Highway No. 1 corridor. Small-Scale Amendment 96-1.4 is the result of a scrivener error. The property is part of the "Prosperity Harbor North" annexation which was the subject of a previous Village of North Palm Beach • Future Land Use Plan amendment (Amendment No. 92-1.2), The -3- Small-Scale Amendment will therefore correct a previous Future Land Use Map Series error. • D. E. Public Facilities And Services Analysis A review of the proposed Small-Scale Amendments in terms of existing Village of North Palm Seach level-of-service standards results in the conclusion that no additional impacts upon services will result. Small-Scale Amendments 96-1.1, 96-1.2, 96-1.3A, 96-1.3B and 96-1.3C are all existing developed properties and no additional impacts are currently anticipated as the result of redevelopment activities. The purpose of Small-Scale Amendment 96-1.4 is to correct a scrivener error. Potential impacts of developing the property were calculated as part of a previous Future Land Use Plan amendment (Amendment No. 92-1.2) which included the subject site. III.
