AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FIARICIA, REZONING A
11.88 ACRE TRACT LOCATED ON U. S. HIGHWAY #1 IN THE VILLAGE OF NORTH PALM BEACH
FROM ZONING DISTRICT R-1 ~ ZONING DISTRICT C-1

BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLARIDA:
' Section 1. Zhat certain 11.88 acre tract in the Village of North
Palm Beach located North of Caroline Avenue (Carolinda Drive), west of U. S. #1,
east of Ellison Wilson Road, and south of the city limits of Palm Beach Gardens,
Florida, the legal description of which is attached hereto as Exhibit "A", and
by reference made a part hereof, be, and the same is hereby, rezoned from Zoning
District R-1 to Zoning District C-1 Neighborhood Comriercial.
Section 2. The Village Clerk is hereby directed to cause the
official zoning map of the Village to be amended by entering the change set
forth above on the official zoning map through crosshatching or other
appropriate means, including redraft by an engineer or surveyor, if necessary.
'Ihe Mayor and Village Clerk are further directed to sign an entry on the
official zoning map as follows: "On the 23rd day of .t~~~p , 1988, by
' official action of the Village Council, the following changes were made in the
official zoning map: shat certain 11.88 acre tract in the Village of North Palm
Beach located north of Caroline Avenue (Carolinda Drive), west of U. S. #1, east
of Ellison Wilson Road, and south of the city limits of Palm Beach Gardens, was
changed-from Zoning District R-1 to Zoning District C-1. there shall be a space
provided for signature by the Village Mayor, whose signature shall be attested
by the Village Clerk.
Section 3. This Ordinance shall take effect immediately upon
passage.

EXHIBIT "A"
A parcel of land being in Government Lots 7 and 8, Section 4, Township 42 South,
Range 43 East, Palm Beach County, Florida, together with Lot 7 and a portion of
Lot 6 of "Plat of Subdivision of Gov't Lot 8 - Section 4, T., 42 S., R. 43 E.",
as recorded in Plat Book 18, Page 4 of the Public Records of Palm Beach County,
Florida being more particularly described as follows:
Beginning at the Southwest corner of said Government Lot 7, same point also
being the Northwest corner of said "Plat of Subdivision of Gov't Lot 8"; thence
North O1°35'39" East along the West line of said Government Lot 7, a distance of
356.07 feet; thence South 85°38'02" East, a distance of 765.13 feet to a R~INT
OF INTERSECTION with the Westerly Rightrof-Way line of State Road Number 5
(also knaan as U. S. Highway Number 1) as now laid out and in use, as shown in
Plat Book 2, Page 113 of the said Public Records and as further modified by
State Road Department of Florida "Disclaimer" for State Road Number 5, Section
93040-2112 dated January 3rd, 1962 on file at the State Road Department of
Florida offices in Ft. Lauderdale, Florida, said point being on the arc of a
curve concave to the Northeast (at which point the radius bears South 85°32'04"
East) having a radius of 1970.08 feet and a central angle of 20°23'29"; thence
Southeasterly along the arc of said curve, same line also being the said
Westerly Right-of-Way Line of State Road Number 5, a distance of 701.15 feet to
a POINT OF INTERSECTION with the Easterly projection of the North line of Lot 6
of said "Plat of Subdivision of Gov't Lot 8"; thence North 88°08'06" West, along
the North line of said IAt 6 and the Easterly projection thereof, a distance of
531.75 feet; thence South O1°23'37" East, a distance of 125.01 feett thence
North 88°08'18" West along a line 25 feet, more or less, North of the centerline
of Caroline Avenue, as now laid out and in use, a distance of 199.94 feet to a
POINT OF INTERSECTION with the Easterly Rightrof-Way Line of. Ellison Wilson
Road, as now laid out and in use having a total Right-of-Way width of 66.00
feet; thence North Ol°22'26" West along the said Easterly Rightrof Way Line of
Ellison-Wilson Road, same line also being the Westerly line of Lots 6 and 7 of
said "Plat of Subdivision of Gov't Lot 8", a distance of 492.84 feet to the
Northwest corner of said Lot 7 of "Plat of Subdivision of Gov't Lot 8"; thence
North 87°20'06" West along the South line of said Gov't Lot 7, same line also
being the North line of said "Plat of Subdivision of Gov't Lot 8", a distance of
102.98 feet to the POINT' OF BEGINNING, LESS the said 66.00 foot Rightrof-Way for
Ellison-47ilson Road.
