HomeMy WebLinkAboutOrdinance 1987-001 Flood Damage Prevention CodeORDINANCE NO. 1-87 AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING CHAPTER 12.5 OF THE VILLAGE OF NORTH PALM BEACH CODE, THE FLOOD DAMAGE PREVENTION CODE FOR THE VILLAGE. Code are ;Hazard. BE IT ORDAINED BY THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA: Section 1. The following sections of the Village of North Palm Beach hereby amended: Section 12.5-7 - Basis For Establishing the Area of Special Flood The areas of special flood hazard identified by the Federal Emergency Management Agency in a scientific and engineering report entitled, "The Flood Insurance Study for the Village of North Palm Beach," dated April 4, 1983, with accompanying flood insurance rate map, are hereby adopted by reference and declared to be a part of this chapter. The flood insurance study is on file at the office of the village clerk, North Palm Beach Village Hall, U.S. Highway 1, North Palm Beach, FLorida. Section 12.5-42(1) - Residential Construction. (1) Residential Construction. New construction and substantial improvement of any residential structure shall have the lowest floor, including basement, elevated to or above the base flood elevation, or 8.5 feet above MSL or 18 inches above the crown of the road serving the structure, whichever is the highest elevation. Section 12.5-42(2)c. c. A Florida registered professional engineer or architect shall !develop the structural design, specifications, and plans for the construction, !and shall certify that the design and methods of construction are in accordance with accepted standards of practice for meeting the applicable provisions of this sub -section, and a record of such certificates which includes the specific elevation (in relation to mean sea level) to which such structures are !floodpiwfed shall be provided to the official set forth in sub -section I12.5-23(3)b. Section 12.5-44 - Coastal High Hazard Areas Coastal high hazard areas (V Zones) are located within the areas of special flood hazard established in Section 12.5-7. These areas have special ;flood hazards associated with high velocity waters from tidal surges and hurricane wave wash; therefore, the following provisions shall apply: (1) Location of structures. A11 buildings or structures shall be ; located landward of the reach of the mean high tide. (2) Construction Methods. a. Elevation. All buildings or structures shall be elevated so that the lowest portion of the horizontal structural members, excluding pilings •or columns, of the lowest floor is located no lower than the base flood elevation level or 8.5 feet above MSL, whichever is higher, with all space below the lowest floor's supporting member open so as not to impede the flow of water, except for breakaway walls as provided for in sub -section (2)d. b. Structural Support. 1. All buildings or structures shall be securely anchored on pilings or columns. 2. The pile or column foundation and the structure attached thereto shall be anchored to resist flotation, collapse and lateral movement due to effects of wind and water acting simultaneously on all building Iearponents. Wind and water loading values shall each have a one percent chance of being equalled or exceeded in any given year (100-year mean recurrence interval). 3. There shall be no fill used for structural support. c. Certification. A Florida registered engineer or architrect ;shall develop the structural design, specifications and plans for the construc- Ition and shall certify that the design and methods of construction to be used are in accordance with accepted standards of practice for meeting the provisions of this sub -section. d. Space below the lowest floor. 1. All new construction and substantial improvements shall have the space below the lowest floor either free of obstruction or constructed with non -supporting breakaway walls, open wood lattice work, or insect screening intended to collapse under wind and water loads without causing collapse, displacement, or other structural damage to the elevated portion of the building or supporting foundation system. For the purposes of this section, a breakaway wall shall have a design safe loading resistance of not less than 10 and no more than 20 pounds per square foot. Use of breakaway wall which exceed a design safe loading resistance of 20 pounds per square foot may be permitted only if a Florida registered professional engineer or architect !certifies that the designs proposed meet the following conditions: (a) Breakaway wall collapse shall result from a water load less than that which would occur during the base flood; and, (b) the elevated portion of the building and supporting 1 foundation system shall not be subject to collapse, displacement, or other i structural damage due to the effects of wind and water loads acting simultan- eously on all building components (structural and non-structural). Maximum ;wind and water loading values to be used in this determination shall each have a one percent change of being equalled or exceeded in any given year (100-year mean recurrence interval). (c) Such enclosed space shall be usable solely for parking of vehicles, building access, or storage. Section 2. The following definitions are added to Section 12.5-5 of the village of North Palm Beach Code. "Start of Construction" includes substantial improvement, and means the date the building permit was issued, provided the actual start of construction, repair, reconstruction, placement, or other improvement was within 180 days of the permit date. The actual start means either the first !placement of permanent construction of a structure on a site, such as the pouring of slab or footings, the installation of piles, the construction of columns, or any work beyond the stage of excavation. Permanent construction does not include land preparation, such as clearing, grading and filling; nor !does it include the installation of streets and/or walkways; nor does it include excavation for a basement, footings, piers, or foundations or the erection of temporary forms; nor does it include the installation on the ;property of accessory buildings, such as garages or sheds not occupied as ,dwelling units or not part of the main structure. 1 "Lowest Floor" - The floor of the lowest enclosed area, including basunent, but excluding any unfinished or flood resistant enclosure, useable solely for vehicle parking, building access, or limited storage. Section 3. The following sections are added to the Village of North Palm Beach Code: Section 12.5-41(5) Mechanical and Utility Equipment. Electrical, heating, ventilation, plumbing, and air conditioning equipment and other service facilities shall be designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding. Section 12.5-41(6) Enclosures Below Lowest Floor. For all new construction and substantial improvements, fully enclosed areas below the lowest floor that are subject to flooding shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwaters. Designs for wetting this requirement must either be certified by a Florida registered professional engineer or architect or must 'wet or exceed the following minimum criteria: a minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided. The bottom of all openings shall be no higher than one foot above grade. Openings may be equipped with screens, louvers, or other coverings or devices provided that they permit the automatic entry and exit of floodwaters. Section 4. Delete the following section of the Village of North Palm Beach Code. Section 12.5-46. Section 12.5-47. Section 5. Effective date. This Ordinance shall take effect immediately upon passage.
