09-22-1994 VC WS-M"-' MINUTES OF WORKSHOP SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, SEPTEMBER 22, 1994 Present: Jeffrey H. Atwater, Vice Mayor V . A . Marks , M . D . , President Pro Tem Tom Valente, Councilman Larry Kelley, Councilman Dennis W. Kelly, Village Manager Kathleen F. Kelly, Village Clerk Absent: Gail H. Vastola, Mayor George Baldwin, Village Attorney ROLL CALL Vice Mayor Atwater called the meeting to order at 7:59 p.m. All members of Council were present except Mayor Vastola, who was out of town. All members of staff were present except George Baldwin, who was ill. STATEMENTS FROM THE PUBLIC Niels Petersen, 2615 Wabash Drive, showed the Council weeds from Wabash Drive, which appeared to be longer than what the Code allows. The Village Manager was directed to look into this matter. BILL 758 - ADDITIONAL ASSESSMENT FOR VIOLATIONS Discussion was held concerning Bill 758, a proposed ordinance amending Section 1-9 of Chapter 1 of the Village Code, establishing an additional assessment for violation of municipal ordinances and violation of a state penal or criminal statute within the Village. This item will be placed on the Regular Session agenda of October 13, 1994. Council requested an accompanying RCA prior to the next meeting. HARBOUR FOINT MARINA P.U.D. AMENDMENT - PARCEL A Discussion was held between the Council and Stephan Yeckes, architect for the project, concerning a request to amend the Harbour Point Marina Planned Unit Development to allow seven townhomes in Parcel "A". Additionally, the proposed modification maintains ten parking spaces, and converts seven commercial boat slips which abut Parcel "A" to privately held and maintained slips by Parcel "A" owners. This was forwarded to the Regular Session of October 13, 1994, with the same conditions as required by the Planning Commission, i.e., 5 ft. public sidewalk required on Monet Road for the entire P.U.D. , from the cul-de-sac all the way to the westerly limit of the P.U.D., and commercial parking area to be constructed concurrent with Parcel "A". Further conditions stated Minutes of Workshop Session Held Thursday, September 22, 1994 were to prohibit "live-aboards" in all boat slips, and to have Homeowner Association documents approved by the Village Council. Written policy prohibiting the renting out of boat slips will also be a condition, and is to be included either in the P.U.D. ordinance or the Homeowner Association documents. All conditions are to be included with the P.U.D. ordinance prior to passage, subject to review and approval by the Village Attorney. HARBOUR POINT MARINA P.U.D. AMENDMENT - PARCEL D Discussion was held concerning another amendment~to the Harbour Point Marina Planned Unit Development to allow 24 townhomes in Parcel "D". This modification would convert 24 commercial boat slips which abut Parcel "D" to privately held and maintained slips under the control of Parcel "D" owners. Tom Hogarth, Director of Public Services, told the Council that the Planning Commission had denied the amendment because of their concerns regarding lot width, building set-backs, availability of convenient parking to remaining commercial boat slips, and questions concerning the operation of the marina and how it affects the entire P.U.D., and open spaces "^ within this particular project. Thomas Baird, the attorney representing Burg & Silvester, the developer, addressed the Council regarding the project. Mr Baird explained that although there is only one P.U.D., there are two developers coming forward with projects, and one master developer. Mr. Baird asked the Council to recognize that some of the issues have not been generated by his client, and cannot be solely resolved by his client. He did state that his client is prepared to include a public sidewalk along their portion of the P.U.D. Mr. Roland Borgland, architect for the project, also spoke before the Council regarding the set-backs variances they are requesting, as stated on the summary sheet. The same conditions regarding rentals of boat slips, live-aboards, approval of Homeowner Association documents, and review and approval by the Village Attorney, which were attached to Parcel "A" apply to Parcel "D". This item will be placed on the Regular Session agenda of October 13, 1994. CABLE TV CONSULTANT SERVICES Discussion was held concerning an~agreement with Liebowitz and Associates for consultant services regarding cable television. The Village Manager estimated that this agreement would not necessitate spending more than $1,000.00. This item was forwarded to the Regular Session agenda of October 13, 1994, with the suggestion of a possible cap. The Council requested further backup on this item, 2 Minutes of Workshop Session Held Thursday, September 22, 1994 with an opinion from Mr. Baldwin regarding a cap. This item was forwarded to the Regular Session of October 13, 1994. STATEMENT BY VICE MAYOR ATWATER Vice Mayor Atwater announced that he has been named President of the Barnett Bank of the Treasure Coast. Mr. Atwater stated that he hopes to complete his term as Vice Mayor and Councilman, and will notify the Council as soon as possible when his resignation is imminent.
