10-23-2003 VC REG-M• MINUTES OF THE REGULAR SESSION OF THE VILLAGE COUNCIL OF NORTH PALM BEACH, FLORIDA HELD THURSDAY, OCTOBER 23, 2003 Present: David B. Norris, Mayor Charles R. O'Meilia, Vice Mayor Joseph A. Tringali, President Pro Tem Dr. Edward M. Eissey, Councilman Don Noel, Councilman Doug Smith, Acting Village Manager George W. Baldwin, Village Attorney Kathleen F. Kelly, CMC, Village Clerk ROLL CALL Mayor Norris called the meeting to order at 7:30 p.m. All members of Council were present. All members of staff were present. INVOCATION AND PLEDGE OF ALLEGIANCE Mayor Norris gave the invocation, and Vice Mayor O'Meilia led the public in the Pledge of Allegiance to the Flag. APPROVAL OF MINUTES The following Minutes were approved as written: Minutes of Special Session held 9/29/03 Minutes of Regular Session held 10/9/03 REPORT OF THE MAYOR Mayor Norris called on Eddie D'Ambra, who introduced members of the U. S. Marine Corps Reserves who presented the Village Council with a plaque in appreciation of the Village's support and participation in the Toys for Tots campaign held last year at the Country Club. CONSENT AGENDA APPROVED • Vice Mayor O'Meilia moved to approve the Consent Agenda. Councilman Noel seconded the motion, and all present voted aye. The following items were approved: Minutes of Regular Session Held Thursday, October 23, 2003 • Received for file the Minutes of the Planning Commission meeting held 9/2/03 Received for file the Minutes of the Recreation Advisory Board meeting held 10/14/03 REPORTS OF SPECIAL COMMITTEES Vice Mayor O'Meilia reported that the League of Cities annual Legislative Round Table would be held on November 26, 2003 at 10:30 a. m. at the Tequesta Country Club. All Council members were urged to attend. VILLAGE MANAGER REPORT Village Manager Doug Smith reported that beginning January 155, the fee for independent contractors employed by the Recreation Department will be 30% instead of 20%. He further reported that the marina decals will be $50 effective January 1, 2004. Any person coming in for a decal between now and the first of the year will pay $25. The Council, by consensus, agreed to the start date of January ls`. Additionally, the $5.00 restaurant credit will change to $4.00, and this will be effective next April. What was advertised in the past year will be carried over through November l4`", and the new credit will be included in the new advertising cycle for the upcoming summer specials. The Council was in agreement with the April start date. Mr. Smith reminded the Council that an amendment to HR Management Partners contract had been previously approved for the purpose of allowing HRMP to review and update the Village Personnel Rules and Regulations. Mr. Smith stated he would give them notice to proceed, but a small budget amendment would be required, since Mr. Smith had to use some of the funds for other purposes. Most of the funding is encumbered. The Council, by consensus, authorized Mr. Smith to give notice to proceed. Discussion was held concerning another rate increase by Adelphia Cable. It was noted that the franchise ordinance requires certain things to be done by Adelphia if they have a rate increase, including official notice to the Village. Further, Council has the right to hold a Public Hearing and require Adelphia to explain the increase. It was suggested that Council write a letter of objection, and demand that they comply with the ordinance. The issue of requesting a bulk rate for the Village will be placed on the next workshop agenda. BILL 1120 -OCCUPATIONAL LICENSING -ENACTED AS ORD. 29-2003 President Pro Tem Tringali moved that Bill 1120 entitled: • AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING SECTION 17-33, LICENSE TAX SCHEDULE, OF 2 Minutes of Regular Session Held Thursday, October 23, 2003 • ARTICLE II, OCCUPATIONAL LICENSES, OF CHAPTER 17 OF THE CODE OF ORDINANCES OF THE VILLAGE, WHICH AMENDMENT INCREASES LICENSE TAXES WITHIN THE VILLAGE AND IS ATTACHED AS EXHIBIT "A' ; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND, PROVIDING FOR AN EFFECTIVE DATE Be placed on second reading and read by title alone. Councilman Noel seconded the motion, and all present voted aye. President Pro Tem Tringali moved to enact Bill 1120 as Ordinance 29-2003. BILL 1121 -BUDGET APPROPRIATION FOR OSBORNE PARK RECREATION BLDG. - PLACED ON FIRST READING Vice Mayor O'Meilia moved that Bill 1121 entitled AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR THE FISCAL YEAR 2003- 2004 TO APPROPRIATE FUNDS IN THE AMOUNT OF $11,500 FOR OSBORNE PARK RECREATION BUII,DING DESIGN AND PREPARATION OF CONSTRUCTION DOCUMENTS INCLUDING ARCHITECTURAL PLANS AND CIVIL SITE PLANS AND CONSTRUCTION SITE SUPERVISION Be placed on first reading and read by title alone. Councilman Eissey seconded the motion. The motion passed 4-1, with Vice Mayor O'Meilia, Councilman Eissey, President Pro Tem Tringali and Mayor Norris voting aye, and Councilman Noel voting nay. BILL 1122 -BUDGET APPROPRIATION FOR MOVING EXPENSES -PLACED ON FIRST READING President Pro Tem Tringali moved that bill 1122 entitled: AN ORDINANCE OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AMENDING THE NORTH PALM BEACH GENERAL FUND BUDGET FOR THE FISCAL YEAR 2003- 2004 TO APPROPRIATE FUNDS IN THE AMOUNT OF $12,000 FOR VILLAGE MANAGER MOVING EXPENSES Be placed on first reading and read by title alone. RESOLUTION 58-2003 ADOPTED -APPOINTING VILLAGE HISTORIAN • 3 Minutes of Regular Session Held Thursday, October 23, 2003 • By written ballot, copies of which are attached to the Minutes of record, the Village Council made its appointment to the position of Village Historian, and the name of Joan Aubrey was entered into Resolution 58-2003. Councilman Eissey moved that Resolution 58-2003 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, APPOINTING A VII,LAGE HISTORIAN Be adopted. President Pro Tem Tringali seconded the motion, and all present voted aye. RESOLUTION 59-2003 ADOPTED -SERVICE AND BUSINESS WORKERS OF AMERICA. LOCAL 125 Vice Mayor O'Meilia moved that Resolution 59-2003 entitled: A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF NORTH PALM BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND VILLAGE CLERK TO ENTER INTO AN AGREEMENT BETWEEN THE VILLAGE AND THE SERVICE AND BUSINESS WORKERS OF AMERICA, LOCAL 125 ATTACHED AS EXH[BIT "A"; AND, PROVIDING FOR AN EFFECTIVE DATE Be adopted. Councilman Noel seconded the motion, and all present voted aye. TOYS FOR TOTS EVENTS President Pro Tem Tringali moved to donate a round of golf (foursome) and carts to be raflled off, with the proceeds going to Toys for Tots, the insurance for skydivers in the amount of $689, projected po]ice overtime expenses, and the use of pool and lifeguards for the pool party. All costs are to be taken from the Country Club fund. Councilman Noel seconded the motion, and all present voted aye.
